WHAT I LIKE TO DO IS WE DO HAVE A GUEST THAT WE'LL BE INTRODUCING SHORTLY TO SPEAK BRIEFLY ON VETERANS DAY AND OUR CELEBRATION, BUT COMMISSIONER JONES DOES HAVE A PROCLAMATION.

I'D LIKE TO READ THAT PROCLAMATION FOR YOU ALL THIS EVENING AS PART OF OUR RECORD.

SANDOVAL COUNTY BOARD OF COUNTY COMMISSIONERS OBSERVANCE OF VETERANS DAY SPONSORED BY DISTRICT 5 COMMISSIONER JOSHUA A JONES WHEREAS THE CONTRIBUTIONS AND SACRIFICES OF TENS OF MILLIONS OF BRAVE AND SELFLESS AMERICANS, THE MEN AND WOMEN WHO SERVE AND HAVE SERVED IN THE ARMED FORCES HAVE BEEN VITAL IN MAINTAINING OUR FREEDOMS AND WAY OF LIFE AND THAT OVER 1 MILLION AMERICANS HAVE GIVEN THEIR LIVES WHILE SERVING IN THE ARMED FORCES OVER THE PAST 250 YEARS AND WHEREAS FOR LOVE OF COUNTRY AND DEDICATION TO DUTY AMERICA'S VETERANS HAVE ENDURED ADVERSITY, LONELINESS, FATIGUE, AND LOSS AND MADE OTHER INCREDIBLE SACRIFICES.

MANY SUSTAINING LIFE ALTERING PHYSICAL INJURIES AND DISABILITIES WHILE OTHERS BEAR THE BURDENS OF EMOTIONAL SCARS FOR THE REMAINDER OF THEIR LIVES.

THESE VETERANS UNDERSTAND THE IMPORTANT TASK BEFORE THE AMERICAN SERVICEMEN AND WOMEN WHO ARE NOW KEEPING WATCH AND WHEREAS WE NOW OWE A GREAT DEBT TO THOSE WHO HAVE SERVED IN DEFENSE OF THIS NATION BECAUSE THE FREEDOM WE ENJOY AS AMERICANS HAS BEEN PURCHASED AND MAINTAINED AT A HIGH PRICE THROUGHOUT OUR HISTORY.

AND WHEREAS IN OWNER OF THESE DEDICATED MEN AND WOMEN WE PLEDGE CONTINUED DEFENSE OF OUR NATION SO THAT THEIR SACRIFICE WILL STAND BEFORE THE ENTIRE WORLD AS A TRIBUTE TO THE SPIRITS AND DETERMINATION OF PEOPLE DEDICATED TO THE PRINCIPLES OF FREEDOM AND DEMOCRACY.

THAT HAVE PRESERVED OUR UNIQUE FORM OF GOVERNMENT DEDICATED TO HUMAN RIGHTS AND SPEC FOR THE INDIVIDUAL.

NOW THEREFORE IT BE RESOLVED THE SANDOVAL COUNTY COMMISSION HEREBY OBSERVES NOVEMBER 11, 2023 AS VETERANS DAY IN HONOR OF THESE MEN AND WOMEN WHO REPRESENT THE BEST OF AMERICA AND DESERVE THE BEST THAT AMERICA CAN PROVIDE THEM.

IT HONORS MILITARY VETERANS WHO HAVE SERVED IN THE U.S.

ARMED FORCES. THE SIGNIFICANCE OF THE STAY DATES BACK TO THE END OF WORLD WAR I.

ON NOVEMBER 11, 1918, AND ARM ASSIST WAS SIGNED BETWEEN THE ALLIES IN GERMANY, MARKING THE END OF HOSTILITIES IN THE WESTERN FRONT AND EFFECTIVELY ENDING WORLD WAR I.

IN 1919, PRESIDENT WOODROW WILSON PROCLAIMED NOVEMBER 11 AS ARMISTICE DAY TO HONOR THE VETERANS OF WORLD WAR I.

LATER IN 1954 AFTER WORLD WAR II AND THE KOREAN WAR THE HOLIDAY WAS OFFICIALLY RENAMED VETERANS DAY TO HONOR AMERICAN VETERANS OF ALL WARS. VETERANS DAY PAYS TRIBUTE TO THE BRAVERY, SACRIFICE, AND PATRIOTISM TO ALL MILITARY VETERANS, ACKNOWLEDGING THEIR CONTRIBUTIONS TO THE COUNTRIES SECURITY AND WELL-BEING.

IT SERVES AS A DAY TO HONOR AND EXPRESS ATTITUDE TO THOSE THAT HAVE SERVED AND CONTINUE TO SERVE IN THE U.S.

ARMED FORCES, RECOGNIZING THEIR DEDICATION AND SELFLESS COMMITMENT TO THE NATION.

WHEREAS NATIONAL NATIVE AMERICAN HERITAGE MONTH IS A TIME FOR US TO CELEBRATE INDIGENOUS PEOPLE PAST, PRESENT, AND REDEDICATE OURSELVES TO HONORING TRIBAL SOVEREIGNTY AND WHEREAS AMERICA HAS NOT ALWAYS DELIVERED ON ITS PROMISE OF EQUAL DIGNITY AND RESPECT FOR NATIVE AMERICANS AND WHEREAS DESPITE OUR SHORTCOMINGS, INDIGENOUS PEOPLE, THEIR GOVERNMENTS, AND THEIR COMMUNITIES HAVE PERSEVERED AND FLORIST PRODUCING TEACHERS, SCHOLARS, SCIENTISTS, AND DOCTORS. WRITERS AND ARTISTS, BUSINESS LEADERS AND ELECTED OFFICIALS, HERE IS IN UNIFORM, AND SO MUCH MORE.

AND WHEREAS WE MUST DO SO MUCH MORE TO ENSURE NATIVE AMERICANS HAVE EVERY OPPORTUNITY TO SUCCEED AND WHEREAS WE APPLAUD ACTIONS SUCH AS THE APPOINTING OF SECRETARY DEB HOLLAND TO THE FIRST EVER NATIVE AMERICAN CABINET SECRETARY.

AND WHEREAS SANDOVAL COUNTY CONTAINS 10 PUEBLOS, THREE CHAPTER HOUSES OF THE NAVAJO NATION AND THE HICKORY APACHE NATION.

AND WHEREAS WE ALWAYS HONOR THE PROFOUND IMPACT NATIVE AMERICANS CONTINUE TO HAVE IN SHAPING OUR COUNTRY, STATE, AND NATION, NOW THEREFORE IT BE RESOLVED THAT THE SANDOVAL COUNTY BOARD OF COUNTY COMMISSIONERS DO HEREBY PROCLAIM THE MONTH OF NOVEMBER AS NATIVE AMERICAN HERITAGE MONTH DONE THIS EIGHTH DAY OF NOVEMBER, 2023 IN BERNALILLO, NEW MEXICO COUNTY OF SANDOVAL COMMISSIONERS OF SANDOVAL SIGNED CHAIRMAN HEIL, CATHERINE BRUCH, DISTRICT 1, AND JC BLOCKS, STRICT TWO.

AS YOU KNOW NOW, NOVEMBER IS NATIVE AMERICAN INDIAN HERITAGE MONTH, ALSO KNOWN AS NATIVE AMERICAN INDIAN MONTH.

IN 1990, CONGRESS PASSED AND GEORGE H TO BE BEST SIGNED A RESOLUTION DESIGNATING NOVEMBER AS THE FIRST NATIVE AMERICAN HERITAGE MONTH, ALSO KNOWN AS AMERICAN INDIAN HISTORY MONTH.

I KNOW THAT WAS A PROCLAMATION, BUT SOMETHING I FOUND ON THE UNITED STATES WEBSITE TODAY, SO I THOUGHT THAT WOULD BE APROPOS FOR THIS PRESENTATION.

THIS EVENING WANTED TO TAKE THE OPPORTUNITY TO PROVIDE YOU INFORMATION ABOUT OUR TRIBAL LIAISON PROGRAM GIVEN THAT IT IS EIGHT OF AMERICAN MONTH.

SO THIS WILL GIVE YOU AN IDEA WHO THE TRIBAL LIAISON PROGRAM CONSISTS OF.

EVELYN SANDOVAL, WHO YOU'VE ALREADY SEEN THIS EVENING.

SHE PROVIDES SERVICES TO THREE NAVAJO CHAPTERS, COUNSELOR, OJI ENCINE, AND TORREON/STARLIGHT.

SHE ALSO PROVIDES TRANSLATION SERVICES.

SO WHO DO WE SERVE? SANDOVAL COUNTY IS HOME TO ALL OR PORTIONS OF 12 NATIVE AMERICAN PUEBLOS AND TRIBAL NATIONS AND, YOU ALREADY HEARD THIS.

IT HAS THE SECOND LARGEST NUMBER OF TRIBAL COMMUNITIES AND LANDHOLDINGS IN THE COUNTRY.

WHAT WE DO. THE PROGRAM WAS INITIALLY ESTABLISHED AS A VOTING RIGHTS PROGRAM.

WAS INITIALLY ESTABLISHED TO PROVIDE VOTING IN ELECTION SERVICES TO THE COUNTIES NATIVE AMERICAN COMMUNITIES.

TODAY OUR TRAVEL LIAISONS MEET AND COLLABORATE WITH TRIBAL LEADERS, COMMUNITY NUMBERS, AND RESIDENTS TO ADDRESS MANY IMPORTANT ISSUES.

THE PROGRAM IS NOW PART OF OUR APARTMENT, THE LEGAL DEPARTMENT IN SANDOVAL COUNTY.

FINALLY, WHAT WE DISCUSSED WITH OUR TRIBAL COMMUNITIES.

THIS MIGHT NOT BE AN EXHAUSTIVE LIST, BUT THIS IS A GOOD PORTION OF WHAT OUR TRIBAL LIAISONS TALK TO MEMBERS IN THEIR VARIOUS -- EDUCATION, EMERGENCY MEDICAL SERVICES, FIRE AND RESCUE, HORSE RACING, MISSING INDIGENOUS PEOPLE, PUBLIC SAFETY, TOURISM, RENEWABLE ENERGY, AND VOTER SERVICES.

SINCE THE PUEBLOS HAVE SLOWLY OPENED UP, WE PLAN ON MORE IN PERSON AWARENESS.

IT IS BEEN A CHALLENGE IN THE PAST YEARS DUE TO COPING.

WE JOIN ON THE LC 16 MEETINGS AND ASSIST IN DISSEMINATING HEALTH AND INFORMATION TO THE PUEBLOS.

I ALSO -- FIVE SANDOVAL PUEBLOS PRESERVATION TEAM TO PROMOTE VOTER AWARENESS.

IT WAS GREAT TO JOIN IN ON THE PROJECT VENTURE ACTIVITY AT THE SCHOOL TO PROMOTE VOTER AWARENESS AND MOCK ELECTION TO THE STUDENTS. I LOOK FORWARD TO JOIN IN ON EVENTS AND OTHER COMMUNITIES AS WELL NOW THAT THE PUEBLOS ARE OPEN TO VISIT.

HOW DO WE KNOW WE ARE DOING WELL? BECAUSE THIS IS THE SECOND MOST IN THE ENTIRE COUNTRY BEHIND SAN DIEGO COUNTY I THINK IN CALIFORNIA MAY HAVE MORE PUEBLO COUNTIES AND WE DO.

HOW DO WE KNOW WE ARE DOING WELL WITH THE MONEY WE ARE SPENDING?

>> MY PART WITH THE NAVAJO NATION, SINCE THE NEW NAVAJO NATION PRESIDENT WAS ELECTED IN JANUARY HE HAS MADE A LOT OF CHANGES.

HE HAS LET A LOT OF PEOPLE GO AND BRING IN NEW PEOPLE.

WHAT I'M DOING NOW IS TRYING TO INTRODUCE MYSELF, INTRODUCE PROGRAM TO THEM AND TRY TO COOPERATE WITH THEM AND INCREASING THE AWARENESS.

AND THEN A LOT OF THE THREE CHAPTERS THAT I WORK WITH IS KIND OF LIKE, IT'S NOT REALLY CONSIDERED NAVAJO NATION BECAUSE IT'S SO FAR OUT FROM WINDOW ROCK.

SO WE HAVE TO BE THE ONES TO GO OUT THERE AND ADVOCATE FOR OUR COMMUNITIES.

SO RIGHT NOW AFTER COVID, SOME OF THE CHAPTER HOUSES ARE BARELY REOPENING.

RIGHT NOW THEY ARE FINALLY REOPENING SO THAT THE PROGRAMS ARE GOING TO COME BACK IN AND START SERVING THE COMMUNITIES AGAIN.

SO RIGHT NOW EVERYTHING IS PROGRESS.

FOR THE PAST WEEK I'VE BEEN VOLUNTEERING AS A POLL WATER IN FOLLOWING THE ABSENTEE PROCESS WITH THE SANDOVAL COUNTY WAREHOUSE WITH SEVERAL OTHER VOLUNTEER POLL WATCHERS. THE EXPERIENCE WAS EXTERNALLY POSITIVE.

THE ABSENTEE BOARD SHOULD BE COMMENDED ON THE PRODUCTIVE AND EFFICIENT MANNER FROM START TO FINISH.

I WOULD LIKE TO GIVE A SPECIAL RECOGNITION TO PRESIDING JUDGES JEFF RINALDI AND BEVERLY MEYEZ FOR THEIR STRONG LEADERSHIP.

YESTERDAY I HAD OPPORTUNITIES TO VISIT SEVERAL VOTING CONVENIENCE CENTERS AND PROVIDED FEEDBACK THIS AFTERNOON.

WELL, I'M HERE TO TELL YOU I WORKED THE ELECTIONS YESTERDAY AND WE ARE NOT THE MINORITY.

PEOPLE WERE COMING IN AND HANDING ME THEIR ID.

I DID NOT ASK FOR IT.

THEY WANTED ME TO HAVE IT.

I STILL HAD TO VERBALLY VERIFY THEIR NAME, YEAR OF BIRTH, AND ADDRESS, BUT THEY FELT CONFIDENT WHEN THEY HANDED IT TO ME AND I DIDN'T REJECT IT BECAUSE WE DIDN'T HAVE TO REJECT IT.

THE OPPORTUNITY FOR VOTER FRAUD AND ELECTION FRAUD ARE TOO GREAT FOR WE THE PEOPLE TO TOLERATE EARLY VOTING IN ANY FORM.

OF ALL THE MESSES THAT NEFARIOUS ACTORS HAVE USED TO DETERMINE ELECTION INTEGRITY EXPANDING THE TIME FROM WHICH THE PEOPLE CAN VOTE FROM A SINGLE DAY TO NUMEROUS DAYS AND SOMETIMES WEEKS HAS BEEN ONE OF THE MOST DESTRUCTIVE.

WE MUST RETURN TO HOLDING FEDERAL ELECTIONS ON A SINGLE DAY.

ABSENTEE VOTING SHOULD BE LIMITED TO VERY FEW EXCEPTIONS, AND EVEN WITH THOSE EXCEPTIONS ALL ABSENTEE BALLOTS SHOULD BE CAST ON ELECTION DAY AT AUTHORIZED POLLING LOCATIONS THAT WILL FORWARD THE BALLOTS CAST TO THE STATE ELECTION OFFICE BY A SECURE CARRIER.

IN THE TERRY PERSONNEL AND THOSE IN THE UNITED STATES EMBASSIES AND SIMILAR SHALL BE PERMITTED TO VOTE ABSENTEE ON ELECTION DAY AT POLLING LOCATIONS ESTABLISHED ON THOSE INSTALLATIONS.

BECAUSE MAGISTRATE COURT IS A STATE OBLIGATION, THEY WILL BE RESPONSIBLE FOR PAYING THIS DEBT.

THIS IS SET UP, AGAIN, AS A 23 YEAR LOAN, BUT IT HAS A FIVE YEAR MATURITY.

THE REASON FOR THAT IS ONCE YOUR NEW MAGISTRATE COURT IS IN PLACE, YOU WILL HAVE TO WRITE, AND WE'VE ALREADY WRITTEN THE DRAFT OF IT, A NEW LEASE BASED ON THE 21 22,000 FT.² AS OPPOSED TO THE 10,000 YOU HAVE RIGHT NOW.

THEREFORE, THE MAGISTRATE COURT WILL BE MAKING THE PAYMENTS ON THE NEW LOAN.

THIS PARTICULAR LOAN ALSO HAS A PROVISION.

THE COUNTY HAS RECENTLY GONE BEFORE THE CAPITAL COMMITTEE IN SANTA FE AND REQUESTED $17 MILLION AND WE HAVE HAD SOME SUPPORT VERBALLY FROM THE ADMINISTRATIVE OFFICE OF THE COURT.

WHAT WOULD HAPPEN IF THAT CAPITAL OUTLAY WENT THROUGH THE LEGISLATIVE PROCESS AND WAS SIGNED BY THE GOVERNOR, THOSE FUNDS WOULD BE AVAILABLE ABOUT THIS TIME NEXT YEAR ABOUT THE TIME ALL THE PAPERWORK GETS CAUGHT UP.

IN ESSENCE, THE COUNTY WOULD ONLY BE BORROWING $2 MILLION INSTEAD OF 19.

THAT IS BASICALLY THE SUMMARY OF THIS TRANSACTION.

IT'S A TWO PART DEAL.

YOU MAY BE BORROWING $19 MILLION.

IF THE LEGISLATOR DOESN'T GIVE YOU CAPITAL OUTLAY AND THE LOAN WILL THEN BE RE-AMORTIZED.

YOU TAKE OUT A NEW LOAN AND BASICALLY REFINANCE THE OTHER BASED ON A 20 YEAR AMORTIZATION OF A COMPLETED BUILDING AND ADMINISTRATIVE OFFICES OF THE COURT WILL MAKE THE ENTIRE LOAN PAYMENTS IN THAT SITUATION.

IF YOU GET THE CAPITAL OUTLAY, $17 MILLION, THEN YOU WOULD ONLY END UP BORROWING $2 MILLION.

THE ADMINISTERING OF OFFICES OF THE COURT WILL BE PAYING MUCH LOWER RENT BECAUSE YOU WOULD ONLY BE BORROWING 2 MILLION AS OPPOSED TO 19 MILLION.

THAT IS WHAT THEY PREFER.

THIS IS A VERY HIGH PRIORITY FOR THEM AND THAT'S BASICALLY A SUMMATION OF THE TRANSACTION.

THE LENDER HAS BEEN UNBELIEVABLY HELPFUL IN WORKING WITH US ON THIS.

THEY UNDERSTAND THEY MAY ONLY BE MAKING A $2 MILLION LOAN, YET THEY ARE GOING TO BE LOCKING UP THEIR CAPITAL AT $19 MILLION.

THE NEW PERSONAL RULES AND RELATIONS WERE APPROVED IN MARCH 2023 AND IMPLEMENT IT ON APRIL 1 FOLLOWING A MULTIYEAR PROCESS OF REVIEW AND DEVELOPMENT.

NOW AFTER UTILIZING THE DOCUMENT THE PAST SEVEN MONTHS, WE HAVE IDENTIFIED A FEW SECTIONS THAT NEED TO BE REVISED DUE TO CONFLICTS, OMISSIONS, OR JUST THE NEED FOR CLARIFICATION.

A FEW RECOMMENDED REVISIONS INCLUDED ADDED DEFINITION FOR RELIGIOUS ACCOMMODATION, THE ADDITION OF A WORD OR STATEMENT DUE TO OMISSION, AND REVISION OF SECTIONS TO CLARIFY AND WHAT TIME SOMEONE CAN USE ANNUAL LEAVE OR SICK TIME BEFORE TAKING AN UNPAID LEAVE OF ABSENCE PAIR OF TODAY WE ARE REQUESTING APPROVAL OF THE RECOMMEND REVISIONS AND I RESPECTFULLY STAND FOR QUESTIONS.

AN ADDITIONAL STATEMENT THAT WAS ADDED WAS THERE WAS SOME CLARIFICATION THAT IF AN EMPLOYEE WAS PROMOTED WITHIN THEIR PROBATIONARY PERIOD, THEY DON'T HAVE TO RESTART THAT PROBATIONARY PERIOD, WHICH IS WHAT WE'VE DONE IN THE PAST.

WE DID ADD A SECTION WHERE AN APPLICANT WAS INELIGIBLE FOR REHIRE, SO THEY WERE EMPLOYED BY THE COUNTY BEFORE.

THE COUNTY MANAGER DOES HAVE AN OPPORTUNITY TO REVIEW THOSE AND IN EXTENUATING CIRCUMSTANCES HE CAN CHANGE THAT TO BE ELIGIBLE FOR REHIRE.

I HAVE A COUPLE OF EXAMPLES THAT ARE PROBABLY NOT BEST FOR THIS AUDIENCE.

THE CLARIFICATION OF WHEN TO USE SICK TIME, ANNUAL LEAVE FOR TAKING UNPAID TIME.

THAT'S ACTUALLY TWO SECTIONS THAT'S IN THIS.

AND I THINK THE LAST ONE WAS WE SEPARATED UNTRUTHFULNESS AND THEN UNTRUTHFULNESS DURING INTERNAL INVESTIGATIONS, SO THAT'S TWO SEPARATE SECTIONS NOW.

FINALLY, WE DID SEPARATE THAT.

IT WASN'T JUST DESIGNATED COUNTY HOLIDAYS THAT SOMEONE COULD RECEIVE HOLIDAY PAY.

IT'S ACTUALLY LEGAL HOLIDAY OR DESIGNATED HOLIDAY.

FINALLY, THERE WAS A CLARIFICATION THAT PREVIOUS EMPLOYEE THAT WORKED FOR THE COUNTY FOR 10 YEARS IF THEY HAD ACCUMULATED OVER 80 HOURS OF ANNUAL LEAVE THEY COULD GET 40 HOURS PAID OUT.

THAT WAS CHANGED IN ERROR TO 160 AND WE REVERTED BACK TO 80.

THESE ARE SOME REALLY HARD-HITTING ISSUES THAT OUR LOBBYIST IS GOING TO BE WORKING

PRISONER TRANSPORT AND EXTRADITION.

A LOT OF THE TIME WE BEAR THE COST EVEN THOUGH THAT'S A STATE FUNCTION.

RISE FUNDING, IT'S A PROGRAM TO REDUCE RECIDIVISM AROUND THE STATE.

EMS SERVICES. OBVIOUSLY, THAT SOMETHING THAT WE PROVIDE AS A CORE FUNCTION.

SOME ADDITIONAL FUNDING IN THERE.

COURTHOUSE FUNDING. WE MENTIONED THAT IN OUR LEGISLATIVE AGENDA.

CURRENTLY, AS WE TALKED ABOUT TODAY, DISTRICT COURT IS THE SOLE RESPONSIBILITY OF COUNTIES.

THAT IS ONE OF THOSE LEFT OVER REQUIREMENTS FROM TERRITORIAL DAYS WHERE THIS ROOM AND A CHAIR AND COUPLE OF TABLES WOULD'VE SUFFICED FOR COURTROOM.

ALSO, ON THE NMC AGENDA IS ELECTED OFFICIAL SALARY INCREASE AND IN THAT ONE I ALWAYS ADD EVERY TIME I TALK TO ANY LEGISLATOR THEY REALLY NEED TO MAKE IT MANDATORY INSTEAD OF PUTTING THE COMMISSION IN A POSITION TO WHERE THEY ARE HAVING TO GIVE THEMSELVES RAISES OR NOT.

WE DONE VERY WELL HERE, BUT IT PUTS THE COMMISSION IN A BAD SPOT.

AND BE FAR BETTER IF THE LEGISLATOR JUST SET THOSE RIGHTS.

YOU'VE SEEN A DRAMATIC DROP IN VOLUNTEERISM.

SANDOVAL COUNTY HAS SOME 200 VOLUNTEERS THAT HELP US PROVIDE SERVICES, BUT OVER TIME THAT VOLUNTEER BASE HAS GOTTEN OLDER AND WE ARE GETTING FEWER AND FEWER RECRUITS.

WE ARE GOING TO BE FORCED TO GO TO MORE PROFESSIONAL SERVICE AS THAT TREND CONTINUES.

THAT IN A NUTSHELL IS THE NMC PROVISIONS.

THE COUNTY CLERK THEN PRESENTS THE CANVAS TO THE COUNTY CANVASSING BOARD FOR APPROVAL.

IF THE BOARD FOUND THAT ANY ELECTION BOARDS HAD NOT SUPPLIED RETURNS, IT IS TO ISSUE A SUMMONS TO THE DELINQUENT BOARD TO APPEAR AND SUPPLY THE MISSING RETURNS.

THAT RULING CAME AFTER THE OTERO COUNTY COMMISSION REFUSED TO APPROVE THE CANVAS OF THE JUNE, 2022 PRIMARY ELECTION.

ON JUNE 13, THE SIXTH DAY OF THE ELECTION, THE OTERO COUNTY COMMISSION VOTED 3-0 AGAINST APPROVAL.

THE NEXT DAY, THE SECRETARY OF STATE ASKED THE NEW MEXICO SUPREME COURT FOR -- TO ORDER THE OTERO COUNTY COMMISSIONS TO APPROVE. THE SUPREME COURT DID NOT EVEN WAIT FOR RESPONSE FROM OTERO COUNTY BEFORE GRANTING LESS THAN 24 HOURS AFTER THE SECRETARY OF STATE FILED A PETITION AND TWO DAYS AFTER OTERO COUNTY COMMISSION REFUSED TO CERTIFY.

THE OTERO COUNTY COMMISSION COMPLIED WITH A COURT ORDER.

THE BOARD HAS NO POWER TO LOOK BEHIND THE RETURNS.

IT MUST APPROVE THE CANVAS PRESENTED BY THE COUNTY CLERK.

AND HAS NO POWER TO QUESTION OR INVESTIGATE THE CONTACT OF THE ELECTION.

IN ESSENCE, WE HAVE AS A BOARD, A CANVASSING BOARD THE AUTHORITY TO APPROVE THE COUNTY CLERK'S HOMEWORK. THAT'S IT.

AND IF SOME PERSON ON THIS BOARD OR PERSONS ON THIS BOARD DECIDE NOT TO VOTE IN FAVOR OF CERTIFYING, OF COURSE THERE'S NO REACTION AS LONG AS IT PASSES.
