DO WE HAVE ANY NURSE PRACTITIONERS HERE THIS EVENING? WE DO? PLEASE COME FORWARD.GREAT. >> CHAIRMAN HEIL: WHY DON'T YOU USE THAT MICROPHONE THERE?
DO WE HAVE IT ON? >> OH, PUSH.
THANK YOU FOR HAVING ME THIS EVENING.
MY NAME IS ANDREA AND I REPRESENT NURSE PRACTITIONER COUNCIL.
I'M THEIR SECRETARY. I APPRECIATE YOU READING THE PROCLAMATION AND EMPHASIZING THE IMPORTANCE THAT NURSE PRACTITIONERS PLAY FOR CARING FOR ALL THE RESIDENTS.
BERNALILLO, SURROUNDING COUNTY, SANDOVAL COUNTY.
I HAVE PRACTICED IN SANDOVAL COUNTY FOR ABOUT 16 YEARS.
I ORIGINALLY STARTED AT PRESBYTERIAN AND LATER WITH REST.
RIGHT NOW JUST OPENED MY OWN PRACTICE.
I WILL BE IN THE NORTH VALLEY.
JUST AS YOU MENTIONED, SERVE THE POPULATION THAT HAS LIMITED ACCESS TO HEALTHCARE.
THERE ARE MANY NEW MEXICANS RIGHT NOW INSURED AND UNINSURED THAT HAVE NO ACCESS.
I APPRECIATE YOU SUPPORTING OUR PROCLAMATION.
THE GOVERNOR HAS AGREED TO SIGN ON AS WELL, SO THAT IS GREAT.
YOU WILL BE POSTED ON THE NURSE PRACTITIONER COUNCIL WEBSITE AND THE COUNTY WILL BE REPRESENT IT ON THERE WITH A PROCLAMATION. THANK YOU.
>> CHAIRMAN HEIL: GOOD, ANDREA.
ANY COMMENTS OR QUESTIONS FROM COMMISSIONERS?
COMMISSIONER MEEK. >> VICE CHAIRMAN MEEK: THANK YOU, CHAIRMAN.
IT'S A GREAT THING WHEN PEOPLE BECOME NURSE PRACTITIONERS.
I CALLED FOR A DOCTORS APPOINTMENT.
THEY TOLD ME I COULD GET IN SOMETIME IN DECEMBER.
HOW ABOUT A NURSE PRACTITIONER? TWO DAYS, THREE DAYS.
IT IS NOT ALWAYS THAT QUICK, BUT EVEN MY WIFE SHE WORKS IN NEONATAL INTENSIVE CARE AND NURSE PRACTITIONERS ARE EXTREMELY IMPORTANT THERE, SO THANK YOU SO MUCH FOR THE PROGRAM AND WE'RE GLAD TO BE RECOGNIZING THE GROUP.
>> THANK YOU. >> CHAIRMAN HEIL: OTHER COMMENTS?
>> J. BLOCK: THANK YOU, MR. CHAIR.
I THINK NURSE PRACTITIONERS CAME ABOUT IN THE 1960S WITH AGAIN, DOCTORS BACK THEN AND TODAY.
THE EDUCATION REQUIREMENTS TO BE A NURSE PRACTITIONER ARE QUITE IMPRESSIVE.
YOU HAVE TO HAVE A MASTERS OF NURSING SCIENCE, I THINK, OR SCIENCE AND NURSING.
HE ALSO CAN HAVE A DOCTORATE IN NURSING PRACTICE.
>> J. BLOCK: WE COUNT ON YOU A LOT.
I'M KIND OF REMINDED A LITTLE BIT IN THE AIR FORCE WHEN I WAS A COMMANDER TWO REMOTE LOCATIONS WE HAD WE CALLED ID MTS. THEY WEREN'T NURSE PRACTITIONERS, BUT THEY WERE SIMILAR TO NAVY CORPSMEN LIKE THIS GENTLEMAN IN THE WHITE SHIRT WAS A NAVY CORPSMEN.
LIKE THE VICE SAID, WE HAVE SUCH A SHORTAGE OF DOCS.
ESPECIALLY IN THE RURAL AREAS.
REALLY APPRECIATE WHAT YOU DO.
AND ALL THE TRAINING YOU HAVE TO GO THROUGH.
I BELIEVE BEING A NURSE PRACTITIONER YOU PROBABLY GET MORE PATIENT INTERACTION THAN SOME OF THE MDS.
APPRECIATE YOU BEING HERE AND THANK YOU FOR PUSHING THIS, TOO.
>> THANK YOU FOR TAKING ALL MY EMAILS.
WE ARE FORTUNATE IN NEW MEXICO WE HAVE FULL SCOPE OF PRACTICE.
OUR NEIGHBORING STATES DON'T HAVE FULL SCOPE OF PRACTICE.
PRACTICE 5 MILES NEXT DOOR AND THEY SERVE RELATE UNDERSERVED PEOPLE THERE.
WE ARE FORTUNATE IN MEXICO THEY SUPPORT US TO HAVE FULL SCOPE.
THANK YOU AGAIN FOR HEARING ME TONIGHT.
>> CHAIRMAN HEIL: DON'T GO AWAY.
WE'RE NOT DONE WITH YOU. [LAUGHTER]
>> VICE CHAIRMAN MEEK: NOW YOU ARE THE FACE.
>> CHAIRMAN HEIL: IT IS A SPECIAL PLEASURE TO ME TO PRESENT THIS ONE.
ANYHOW, LET'S HAVE YOU STEP UP HERE.
WE'RE GOING TO TAKE A PICTURE WITH YOU.
>> J. BLOCK: YOU MIGHT WANT TO HELP OUT THIS GUY.
[00:15:25]
HE'S HAVING SOME PAIN.>> CHAIRMAN HEIL: SO MOVING ON TO ITEM 5B.
[5.B.Proclamation- Designating the month of October as Breast Cancer Awareness Month (Sponsored by District 2 Commissioner Jay C. Block)]
WE HAVE A PROCLAMATION TO BE PRESENTED BY COMMISSIONER BLOCK.BLOCK: THANK YOU, MR. CHAIR. EVERY OCTOBER I DO THIS.
WELL, EVERY SEPTEMBER I DO PROSTATE AWARENESS MONTH AND EVERY OCTOBER I DO BREAST CANCER AWARENESS MONTH BECAUSE MY MOTHER PASSED AWAY FROM THAT ALMOST 12 YEARS AGO NOW.
SO WITH THAT, SANDOVAL COUNTY BOARD OF COUNTY MISSIONARIES DESIGNATE THE MONTH OF OCTOBER IS BREAST CANCER AWARENESS MONTH SPONSORED BY DISTRICT 2 COMMISSIONER JC BLOCK CONTINUES TO TOUCH FAMILIES AND HONOR THE COURAGE AND STRENGTH OF BREAST CANCER SURVIVORS.
WE WILL NEVER FORGET THOSE THAT LOST THEIR LIVES LIKE MY MOTHER, SANDRA J BLOCK AND WHEREAS IN 2023 THERE HAVE BEEN OVER 350,000 WOMEN DIAGNOSED WITH BREAST CANCER IN THE UNITED STATES.
AND WHEREAS THE END OF 2023, OVER 43,000 WOMEN WILL DIE IN THE UNITED STATES.
WORLDWIDE BREAST CANCER IS THE FIFTH READING CAUSE OF DEATH.
AND WHEREAS WE MUST CONTINUE TO EDUCATE PEOPLE TO RECOGNIZE THE EARLY WARNING SIGNS OF BREAST CANCER AND PROVIDE AFFORDABLE AND ACCESSIBLE HEALTHCARE SO PEOPLE CAN RECEIVE THE BEST HEALTHCARE POSSIBLE WHEN DIAGNOSED.
AND WHEREAS BY WORKING TOGETHER WE CAN REDUCE BREAST CANCER DEATHS, INCREASE THE SURVIVAL RATE AND WITH ONE DAY WITH GOD'S GRACE FIND THE CURE. NOW THEREFORE BE IT RESOLVED THE SANDOVAL COUNTY BOARD OF COUNTY COMMISSIONERS DO HEREBY CLAIM THE MONTH OF OCTOBER AS BREAST CANCER AWARENESS MONTH DONE THIS 25 DAY OF OCTOBER, 2023 COMMISSIONERS OF SANDOVAL COUNTY DAVID J HEIL AND JOSHUA JONES DISTRICT 5.
I WILL JUST SAY FOR THE WOMEN OUT THERE, PLEASE MAKE SURE YOU'RE GETTING YOUR MAMMOGRAMS EVERY YEAR AND FOR THE MEN OUT THERE THAT ARE SUPPORTING THEIR WIVES AND SPOUSE OR PARTNER GOING THROUGH THIS, I'VE BEEN THERE.
THANK YOU, MR. CHAIR. >> CHAIRMAN HEIL: THANK YOU, COMMISSIONER BLOCK.
[6.A.Opioid and Fentanyl Crisis Presentation]
WE'RE MOVING ON TO PRESENTATION ON OPIOID AND FENTANYL CRISIS.CHAIR, IF I MAY. >> CHAIRMAN HEIL: YOU MAY.
>> J. JONES: JUST LIKE TO DO A BRIEF INTRODUCTION.
AS YOU WILL SOON FIND OUT, MR. LARRY KENEMORE NEEDS NO INTRODUCTION.
HE IS WITH -- AMERICAN TASK FORCE.
THEY ARE DOING IMPORTANT WORK.
I HAD THE OPPORTUNITY TO MEET LARRY KENEMORE IN DETROIT, MICHIGAN.
WHERE I MET HIM HE WAS DOING A NOLOXONE TRAINING FOR FIREFIGHTERS, I BELIEVE.
THAT'S THE TYPE OF DEDICATION THAT LARRY KENEMORE HAS AND I KNOW THAT LARRY IS WORKING WITH LOCAL ROTARY GROUPS HERE IN THE STATE OF NEW MEXICO TO DO AND BRING THAT SAME AWARENESS AND THAT SAME TRAINING.
YOU KNOW, I THINK WE ALL RECOGNIZE THAT FENTANYL IS A HUGE PROBLEM NATIONWIDE AND I DON'T THINK THIS PRESENTATION COULD BE ANY MORE TIMELY THAN MR. KENEMORE COMING IN TODAY.
[00:20:06]
LARRY KENEMORE HERE TO PRESENT TODAY.I'M NOT GOING TO STEAL ANY OF YOUR THUNDER.
I'M SURE YOU HAVE INTRODUCTION PREPARED FOR US, BUT WITHOUT FURTHER ADO, I'D LIKE TO REPRESENT MR.
KENEMORE: WE GOT TO TALK OLD TIMES, BUT MY NAME IS LARRY KENEMORE.
ON THE NORTH AMERICAN TASK FORCE LEADER --
>> J. BLOCK: CAN YOU SPEAK INTO THE MIC, SIR?
>> L. KENEMORE: I'M ON THE ROAD REACTION GROUP FOR ADDICTION PREVENTION.
WE SPENT ABOUT THREE YEARS LOOKING AT THE ADDICTION CRISIS IN THIS COUNTRY.
WHAT IS GOING ON, WHAT EVERYBODY HAS TRIED AND SO THAT NOTHING IS WORKING.
YOU'RE GOING TO FIND OUT WE BROUGHT A GROUP OF ROTARIANS THAT ARE EXPERTS IN THEIR FIELD AND BROUGHT TOGETHER THAT'S TO ATTACK THIS ISSUE AND TAKE CARE OF A PIPELINE WE HAVE.
PIPELINE IS WE HAVE CHILDREN NOW AGES 12, 13, AND 14 THAT ARE GETTING HOOKED ON DRUGS AND THEY STAY ADDICTED FOR YEARS AND YEARS AND YEARS AND THAT PIPELINE KEEPS FILLING UP.
THERE WE GO. SO EVERYBODY KNOWS WHO ROTARY IS.
WE ERADICATED POLIO WORLDWIDE.
IN FACT, THERE'S ONLY TWO CASES WORLDWIDE.
THAT'S WHAT WE ARE ACTUALLY KNOWN FOR.
YOU WILL WATCH THIS REAL CLOSELY BECAUSE IT SHOWS YOU THE 10 YEARS OF WHERE THEY ARE AND HOW THEY TOOK PLACE AND YOU WILL SEE NEW MEXICO IS ON THERE.
NOW IT'S TIME FOR THE NEXT CHALLENGE.
WE CAME UP WITH PROJECT SMART, AND EDUCATION PROGRAM SO WE CAN HAVE A 20 YEAR PRODUCT GRADUATE AND GENERATION OF CHILDREN THAT NO WHAT ADDICTION IS AND WHY THEY DON'T WANT TO BE ADDICTED.
GET RID OF THE MEDICATIONS YOU HAVE IN YOUR HOME.
THIS IS OUR BOARD OF DIRECTORS.
YOU CAN SEE UP IN THE TOP CORNER RETIRED FIRE CHIEF FROM THE CITY OF DETROIT, MICHIGAN.
THESE ARE ALL EXPERTS IN THEIR FIELD.
THEY ARE ALL PARENTS OF CHILDREN THAT HAVE DIED FROM ADDICTION, ALSO.
THIS IS ME., RETIRED PARAMEDIC 24 YEARS.
I GAVE LOTS OF NOLOXONE IN MY DAYS.
ONE OF THE REASONS I GOT PICKED TO BE -- LEADER.
NALOXONE TRAINING ARE EQUIPPED WITH INTRANASAL NALOXONE.
I'M SURE YOUR DEPUTIES, WE WERE TALKING ABOUT IT EARLIER.
THE PROBLEM IS WITH THIS NEW FENTANYL, ZILINE AND EVERYTHING ELSE THEY ARE MIXING WITH THESE RIGHT NOW, THE NALOXONE IS NOT ENOUGH.
WE HAVE LOTS OF VIDEOS OF BODY CAMERAS.
WE HAVE ONE ON OUR WEBSITE -- IT WAS COLD TO: 00 IN THE MORNING.
TOOK IT OUT, WIPED HER SLEEVE ON HER NOSE, 30 SECONDS LATER SHE WAS DOWN.
IF NALOXONE TRAINING BECAME AS PREVALENT AS CPR, MANY LIVES WOULD BE SAVED.
YOU'LL NOTICE IN OCTOBER 6, 2022 IN ALBUQUERQUE, YOU'LL NOTICE ALL THESE KIDS THERE WAS MULTIPLE OVERDOSES AT HIGH SCHOOL AND THEY HAD NO NALOXONE. ONE OF THE THINGS THAT ROTARY ADVOCATES FOR IS GETTING NALOXONE IN THE CLASSROOM.
WE HAVE A VIDEO OF A -- SHE COMES BACK, OPENS A CABINET, BRINGS THE NALOXONE BACK AND GUESS WHAT? IT'S TOO LATE. PEOPLE NEED TO UNDERSTAND IT'S NOT MINUTES ACCOUNT IN OVERDOSE.
IT SECONDS BECAUSE BRAIN CELLS ARE DYING.
ROTARY HAS COLLABORATION WITH THE NEWEST STRONGEST NALOXONE.
I GAVE EACH OF YOU ONE OF THEM.
PLEASE CARRY IT WITH YOU EVERYWHERE YOU GO.
ONLY THING I CAN TELL YOU IS DON'T PRACTICE.
THERE'S ONLY ONE DOSE IN THERE.
[00:25:01]
STICKING IN SOME OF HIS NOSE, BUT DON'T PRACTICE.TWICE THE DOSAGE OF ANYTHING ELSE THAT IS ON THE MARKET.
SO WHY KLOXXADO? WILL NARCAN STILL WORK? WE DO KNOW THAT A LOT OF IT IS NOT WORKING.
THEY ARE HAVING TO GIVE MULTIPLE DOSES.
BY THE WAY, THIS PRODUCT IS ALMOST 50% LESS THAN THE OTHER PRODUCT IT'S ON THE MARKET.
YOU SHOULD BE TAKING CONSIDERATION OF THAT IN YOUR BUDGET WHEN YOU ARE DOING YOU ARE BUDGETING.
>> THIS IS THE POLICE OFFICER THAT PUT HER HAND IN THE BAG, TOOK IT OUT, AND YOU'RE GOING TO SEE WHAT HAPPENS HERE IN A SECOND.
>> THEY CLEAR TRAFFIC ON ONE YET?
>> ALL YOU DO IS STICK IT IN THE NOSE AND DOSE IT.
BUT WE NEED STRONGER NALOXONE.
YOUR OFFICERS NEED TO BE CARRYING PROBABLY NALOXONE FOR THEIR PEOPLE.
>> COME ON, COURTNEY. >> GET AN ANSWER BACK.
>> SHE'S BREATHING. >> STAY WITH ME.
>> L. KENEMORE: SO THIS IS THAT POLICE DEPARTMENT.
THE APOPKA POLICE DEPARTMENT PROVIDED -- SHE'S THE THIRD ONE FROM THE RIGHT THERE.
SHE'S VERY THANKFUL THEY NOW HAVE NALOXONE TO CARRY.
WHAT DO WE DO? WE COME TO TOWN, THE ROTARY DOES.
WE PUT ON FREE TRAINING, THE PEOPLE IN YOUR COMMUNITY AND GIVE THEM NALOXONE TO USE.
THEY ARE TRAINING 100 PEOPLE A WEEK HERE IN TALLAHASSEE, FLORIDA.
MACRI. BEHOLD THE CLASS ONCE A MONTH.
THIS IS ANOTHER ONE OF HIS CLASSES.
THIS IS IN SOUTHGATE, MICHIGAN.
THIS IS ANOTHER ONE IN MICHIGAN.
CANFIELD, OHIO, ALL ACROSS THE COUNTRY.
WE TRAINED 250 TRAINERS ALL ACROSS THE STATE.
COMPARE THOSE NUMBERS WITH OVERDOSE DEATHS AND THAT LOCAL COMMUNITY AND THERE'S A REASON WHY.
THE REASON WHY IS WE PROVED IT IN FLORIDA.
THIS WAS JUST RELEASED A WEEK AGO.
2.6% DECREASE IN DEATHS BECAUSE OF NALOXONE.
THE ONLY THING THAT WAS DONE DIFFERENT WAS PEOPLE CARRYING NALOXONE.
THE ONLY STATE THAT HAS A DECREASE IN OVER DOSE DEATHS BECAUSE OF NALOXONE TRAINING.
I GAVE YOU ALL A COPY OF THIS.
THIS WAS THE ACTUAL POLICE REPORT THAT SHOWED YOU HE HAD TO GIVE MULTIPLE DOSES OF THE PRODUCT AND HE THINKS THERE NEEDS TO BE A STRONGER PRODUCT BECAUSE HE THINKS THEY ARE GOING TO LOSE SOMEBODY.
THEY WILL DISTRIBUTE IT THROUGHOUT YOUR COMMUNITY.
IT'S GOT A 330 NUMBER ON THERE.
IF YOU CALL THAT, YOU CAN GET SOMEBODY TREATMENT IMMEDIATELY THROUGH TELEHEALTH.
WE NEED TO GET THEM INTO TREATMENT BECAUSE WE GET THEM INTO TREATMENT RIGHT THERE 85% SUCCESS RATE.
[00:30:06]
POLICE OFFICERS, EMERGENCY ROOM DOCTORS, EVERYBODY NEEDS TO HAVE ONE OF THESE CARDS AND CARRY THEM AROUND BECAUSE AFTER YOU RESUSCITATE SOMEBODY YOU NEED TO GET THEM INTO TREATMENT. THIS IS DONE BY THE NORTH CAROLINA MEDICAL SOCIETY.WE DO KNOW THAT SINCE TELEHEALTH AND COVID IS DEFINITELY NEEDED BIG TIME.
SO THAT'S THE CARD. HOW DOES IT WORK? WE'LL SIMPLE. I'D LIKE TO INTRODUCE YOU TO THE FIRST CLUB IN NEW MEXICO THAT TOOK THIS PROJECT ON.
IF YOU GUYS WOULD LIKE TO STAND UP.
THAT IS THERE PROJECT SMART COMMITTEE THAT HAVE TAKEN THIS ON.
[APPLAUSE] SO LAST THING I'D LIKE TO TELL YOU IS THIS.
JUST REMEMBER THIS NUMBER THAT WE STARTED PUBLISHING.
MORE PEOPLE HAVE DIED FROM ADDICTION THAT HAVE DIED FROM AIDS, COVID, AND POLIO COMBINED 221.
MORE PEOPLE HAVE DIED FROM ADDICTION IN THIS COUNTRY FROM AIDS, POLIO, AND COVID 221.
LASTLY, I WILL TELL YOU FROM JANUARY THIS YEAR TO SEPTEMBER OF THIS YEAR, THERE HAVE BEEN 23 CHILDREN WHO DIED IN A CLASSROOM FROM OVERDOSE AGE 11-17.
I'M NOT TALKING ABOUT 16 YEARS OLD.
YOU NEED TO GET IT INTO THE COMMUNITY.
THIS IS OUR PROJECT SMART COMMITTEE AND I'LL BE GLAD TO ANSWER ANY QUESTIONS YOU HAVE.
I'D LIKE YOU ALL TO GO ON OUR WEBSITE.
CHRIS SCHULTZ, 31 YEAR ADDICTS.
HE'S NOW THE PRESIDENT OF THE ROTARY CLUB.
YELLS ALSO AN ELECTRICAL CONTRACTOR.
HE LOST CUSTODY OF HIS CHILDREN, HIS WIFE DIVORCED HIM, TURNED HIS LIFE AROUND.
WATCH IT. HE WILL TELL YOU THE WHOLE STORY.
I'M READY FOR ANY QUESTIONS YOU HAVE.
>> CHAIRMAN HEIL: ANY QUESTIONS, COMMISSIONERS?
BLOCK: THANK YOU, MR. CHAIR. I'LL JUST CALL YOU CORPSMAN.
YOU KNOW, IT'S EASY TO GO OUT THERE AND FIND A LOT OF STATS AND YOU DID THIS.
YOU LIVE IN ARKANSAS, IS THAT CORRECT?
>> L. KENEMORE: THAT'S CORRECT.
>> J. BLOCK: WORKING AT THAT MAP YOU HAVE BIG.
WHICH BY THE WAY, I WOULD ARGUE THAT NEW MEXICO MIGHT BE A BORDER STATE, BUT EVERY STATE IS A BORDER STATE BECAUSE OF THE DRUGS THAT COME IN THROUGH THE BORDER.
LET ME RUN THE NUMBERS AND SEE WHAT YOU KNOW.
WHAT IS THE NUMBER 680,491 MEAN TO YOU?
BLOCK: WHAT DOES THE NUMBER 685,491 MEAN TO YOU?
>> J. BLOCK: SO THAT IS THE NUMBER OF AMERICANS KILLED IN EVERY MAJOR WAR IN THE UNITED STATES IN THE HISTORY OF OUR COUNTRY BESIDES THE CIVIL WAR.
I COME UP WITH THAT NUMBER FROM THE REVOLUTIONARY WAR 1812, SPANISH-AMERICAN WAR, WORLD WAR I, WORLD WAR II SKI, AFGHANISTAN, WHERE I WAS IN IRAQ.
685,000 AMERICANS, BUT YET SINCE 1999, OUR LIFETIME, 1 MILLION AMERICANS HAVE DIED OF OVERDOSES.
IN FACT, OVERDOSE DEATHS EXCEEDED MURDER RATES IN 20 21 X 66% AND MEN ARE IN A CRISIS IN THIS COUNTRY. MEN ARE ACTUALLY TWICE LIKELY TO OVERDOSE THAN WOMEN.
SO IF YOU WORKING FOR A DAY, AND YOU TALKED ABOUT POLIO AND COVID AND ALL THAT.
IT SHOWS JUST HOW MUCH OF A PROBLEM IT IS NOT JUST FOR ADDICTS, BUT I WORRY ABOUT OUR POLICE AND FIRST RESPONDERS.
BY THE WAY, FENTANYL I WOULD ALSO ARGUE DOESN'T GIVE A CRAP ABOUT YOUR RACE, YOUR SOCIOECONOMIC STATUS, ABOUT YOUR SEXUAL ORIENTATION, ABOUT YOUR GENDER, HOW OLD YOU ARE, YOUR RELIGION.
DOESN'T CARE ABOUT ANY OF THAT.
[00:35:02]
YOU BEEN AROUND THIS. HOW DO WE FIX THIS?>> L. KENEMORE: THAT'S WHAT ROTARY LOOKED AT, WHAT PEOPLE HAVE TRIED.
WE DISCOVERED THERE'S ALL THESE ORGANIZATIONS AND GRANT FUNDS, BUT THEY ALL LIVE IN SILOS.
THEY ARE AFRAID TO WORK WITH ANYBODY ELSE BECAUSE THEY MIGHT LOSE THEIR FUNDING.
SO ROTARY SAID WE ARE GOING TO BRING ALL THOSE THINGS TOGETHER IN A PROJECT FOR ROTARY TO DO BECAUSE WE DON'T HAVE TO WORRY ABOUT GRANTS OR FUNDING BECAUSE IT'S A FUNDED PROJECT WITH ROTARY.
WHAT WE'RE SAYING IS WE'RE GOING TO DO ALL THAT IS ROTARY DID THE POLIO.
WE'RE GOING TO TAKE CARE OF THE PROBLEM TRAINING THE KIDS FIRST GRADE THROUGH 12TH GRADE.
DOES ANYBODY KNOW WHY JUST SAY NO AND DEAR FAILED? THIS IS AN INTERESTING STATISTIC.
JUST SAY NO AND THEY ARE FAILED BECAUSE YOU CAN'T TAKE FIRST-GRADERS THROUGH SIXTH-GRADERS, PUT THEM IN A ROOM AND GIVE THEM SPEECH FOR HALF-HOUR AND THEY ARE GOING TO UNDERSTAND WHAT THEY ARE TALKING ABOUT.
EDUCATORS CAME AND TOLD US WE TEACH MATH AT THE FIRST GRADE LEVEL, THEN AT THE SECOND GRADE LEVEL.
WE NEED TO HAVE A PROGRAM WHERE WE TEACH THESE KIDS EACH YEAR AT THE GRADE LEVEL SO THAT THEY KNOW WHEN THEY GRADUATE WHAT ADDICTION IS AND WHY THEY DON'T WANT TO MEET AND ACTED.
WE NEED TO STOP THEM FROM GETTING IN THAT PIPELINE.
THEN WE NEED TO DO THE TREATMENT AND RECOVERY WHILE THEY ARE IN THE PIPELINE SO WE CAN GET THEM OUT OF THE PIPELINE SO THAT PIPELINE QUITS FILLING UP WITH ALL THESE PEOPLE TO BECOME ADDICTED AND KEEP DYING ON US.
THE OBJECT OF THE NALOXONE IS TO KEEP THEM ALIVE SO YOU CAN GET THEM INTO TREATMENT.
WE GET THEM INTO TREATMENT, 85% SUCCESS RATE.
>> CHAIRMAN HEIL: OTHER COMMENTS? I GUESS I HAVE ONE.
THERE ARE TWO ROTARY CLUBS IN RIO RANCHO.
THE SUNSHINE CLUB AND NOON CLUB.
WILL YOU BE WORKING WITH THEM ON THIS PROJECT?
>> CHAIRMAN HEIL: THE KIWANIS CLUB --
>> L. KENEMORE: THEY TOLD ME THAT.
JOHNSON: MR. CHAIR, I DO HAVE A FOLLOW-UP COMMENT.
YOU KNOW, I THINK WE ALL KNOW SOMEONE WHO'S BEEN AFFECTED BY FENTANYL OVERDOSE OR SOMEONE CLOSE TO US TO HAVE EXPERIENCED IN OVERDOSE.
I WAS TALKING WITH LARRY MAYBE WE CAN HAVE OR TWO WEEKS AGO.
EVERYBODY THINKS THIS IS JUST YOU KNOW, YOU REVERSE THEM AND THEY GO ON THEIR WAY.
WHEN I WAS A PARAMEDIC IN 124 HOUR SHIFT, CHIEF, I RESUSCITATED THE LADY THREE TIMES.
DO YOU HAVE ANY IDEA WHAT SHE SAID ALL THREE TIMES WHEN SHE WOKE UP? DO YOU KNOW HOW MUCH THAT COST ME? THE ONLY WORD SHE SAID ALL THREE TIMES.
YOU DON'T UNDERSTAND IT'S NOT A DISEASE, JUST THINK ABOUT THAT.
THEY REALIZE THEY ARE DYING, BUT THE ONLY THING THEY CARE ABOUT IS HOW MUCH IT COST THEM.
IT IS A DISEASE THAT NEEDS TO BE TREATED.
>> J. JONES: CAN YOU TELL US ABOUT THE OVERDOSE YOU JUST RECENTLY OVERTURNED IN ARIZONA?
>> L. KENEMORE: I WAS IN TUCSON, ARIZONA WE CAN BEFORE LAST FOR ROTARY DISTRICT CONFERENCE.
I DROVE DOWN THERE AND I STOPPED AT A LEFT-HAND TURN LANE AND THE CORNER OF MY EYE THERE'S A GUY LAYING ON THE CURB LEG UP 4 LANE HWY.
WITH WAYS. IS A LITTLE MOPED THERE AND IT LOOKS LIKE HE'S FALLEN OFF AND NOBODY STOPPED.
I'M THINKING WELL, MAYBE I JUST PULL OVER AND WALK UP THERE.
HE'S NOT BREATHING. GAVE HIM NALOXONE AND RESUSCITATED HIM.
ALL THE FIRST RESPONDERS DID WAS PAT HIM ON THE SHOULDER AND SAY BE SAFE.
HE NEEDED TO BE IN TREATMENT MEDIALLY.
GOT A PICTURE OF THE GUY LAYING THERE, GAVE HIM THE NALOXONE.
IT WAS PRETTY INTERESTING BECAUSE 4 LANE HWY.
BOTH STREETS AND EVERYBODY IS DRIVING.
SO IT'S EVERYWHERE. BY THE WAY, EVERYBODY IN THE ROTARY SAID THAT'S A REALLY NICE NEIGHBORHOOD.
[00:40:03]
WHAT IS THAT GUY DOING THERE? THAT'S A REALLY NICE NEIGHBORHOOD.IT'S EVERYWHERE. DOESN'T MATTER WHERE IT'S AT.
IT'S EVERYWHERE. ANYMORE QUESTIONS I'D BE GLAD TO ANSWER THEM FOR YOU, BUT WE LOOK FORWARD TO WORKING WITH YOUR COUNTY TO GET THIS PROJECT UP AND RUNNING.
AND WITH THE HELP OF THE ALBUQUERQUE CLUBS, TOO.
>> CHAIRMAN HEIL: WELL, WE CERTAINLY APPRECIATE THE ISSUE AND IMPORTANCE YOU BRING.
[8.PUBLIC COMMENT AND COMMUNICATIONS]
PUBLIC COMMENT. I WILL READ THE NAMES OF THOSE WHO WISH TO SPEAK IN GROUPS OF THREE.WE HAVE JOHN VELTRY, MARY BURGESS, RAMONA GOLDSBY.
JOHN VELTRY. TONIGHT I'M GOING TO TALK ABOUT CITIZENSHIP AND BORDERS.
LIKEWISE, UNSECURED BORDERS IN THE UNITED STATES IS NO LONGER A SOVEREIGN NATION.
WITHOUT ELECTIONS IN THE UNITED STATES WE ARE NOTHING MORE THAN A BANANA REPUBLIC.
THE MISSION TO RESTORE ELECTION INTEGRITY BEGINS WITH SECURING OUR BORDERS FROM INVASION, JUST LIKE JAY THAT HAVE CURRENTLY INVADED AT AN UNPRECEDENTED LEVEL IN THESE UNITED STATES.
THE GOVERNMENT HAS ALL KINDS OF RECORDS ON US.
THINK ABOUT IT. THEY CAN CHECK OUR INCOME TAXES BY OUR RESIDENTS.
THEY CAN CHECK IF WE'RE ABLE TO VOTE BECAUSE WE HAVE TO HAVE A RESIDENCE.
THEY CAN DECLARE RESIDENCY EVERY 10 YEARS THROUGH THE CENSUS BUREAU.
THINK ABOUT IT. THESE BORDERS ARE WIDE OPEN.
I'VE GOT 30 SECONDS TO THINK ABOUT HOW I WANT TO SAY THIS.
THE PROBLEM WITH THE PHENOL IS GOING TO CONTINUE TO COMPOUND.
IT WON'T GO AWAY UNTIL THESE BORDERS ARE CLOSED.
THINK ABOUT IT. THEY ARE COMING IN EVERY DAY, MILLIONS.
UNTIL THOSE BORDERS ARE CLOSED, THE DRUGS WILL CONTINUE TO COME IN.
LIKE JAY SAID, IT'S EVERY STATE.
IT'S NOT JUST THE SOUTHERN BORDERS.
IT'S ALL STATES AND INTO CANADA.
IN MY OPINION, WE NEED TO DO SOMETHING ABOUT IT AND AT THE VERY LEAST IF ANYTHING, PRAY.
>> CHAIRMAN HEIL: THANK YOU, JOHN.
MARY BURGESS, RAMONA GOLDSBY, AND MARY JO STREET'S.
>> I'M MARY BURGESS. I'M FROM RIO RANCHO AND PLEASE RECORD MY STATEMENT.
SO WE HAVE NOTES ON NEW MEXICO GAS COMPANY IS SEEKING APPROVAL FROM THE STATE'S PRC TO BUILD LIQUEFIED NATURAL GAS PLANT IN BERNALILLO, COUNTY.
THE PROPOSED LOCATION IS IN THE NORTHWEST PORTION OF THE COUNTY ON LAND ANNEXED INTO RIO RANCHO.
NEW MEXICO GAS COMPANY HAS STATED THAT THE PLANT WILL ENSURE MORE DELIVERABLE AND RELIABLE GAS TO ITS CUSTOMERS AND WILL REDUCE THE PRICE VOLATILITY.
THE PRC HAS DECLINED TO APPROVE THE END AND GAS REQUEST WITHOUT A PUBLIC HEARING TO DETERMINE THE MERITS OF THE PROPOSED GAS PLAN.
OPPONENTS OF THE LNG GAS PLANT HAVE POINTED TO A RANGE OF ENVIRONMENTAL AND ECONOMIC CONCERNS.
[00:45:02]
FOR EXAMPLE, THE PLANT'S RELEASE OF EMISSIONS FROM INTERMITTENT VENTING OR LEAKS WILL EXACERBATE EXISTING AIR QUALITY ISSUES, EXPOSING RESIDENTS TO INCREASED AIR POLLUTION.METHANE LEAKS POSE AN IMMEDIATE THREAT BECAUSE OF THE RISK OF FIRE.
OPPONENTS ALSO DISPUTE -- OKAY.
ATTACHED TO THIS IS THE ORDINANCE FOR MOST OF US WHO OPPOSE THIS PLAN FOR THE PLANT, SO THANK YOU.
>> CHAIRMAN HEIL: THANK YOU, MARY. RAMONA FOLLOWED BY MARY JO FOLLOWED BY DR.
GERALDO -- I'M NOT GOING TO TRY THAT.
>> AS HE PASSES THAT OUT, MY NAME IS RAMONA GOLDSBY.
GOOD EVENING, TARA HEIL AND COMMISSIONERS.
I WANT MY COMMENTS ON THE RECORD.
I WANT TO THANK COUNTY MANAGER JOHNSON FOR HIS HELP THIS WEEK AND GETTING SOME QUESTIONS I HAD ABOUT PUBLIC HEARINGS AND THE PROCESSES SANDOVAL COUNTY COMMISSION UTILIZES.
I ALSO WANT TO REMIND EVERYONE TO GET OUT AND VOTE.
SEVERAL WEEKS AGO I PRESENTED A DRAFT OF ENABLING ACT ORDINANCE TO THE COMMISSION.
THE LAST COUNTY COMMISSION MEETING, CHAIRED HEIL PRESENTED A RESPONSE TO THAT REQUEST.
I WANT TO THANK YOU FOR YOUR RESPONSE, CHAIR HEIL.
EVEN THOUGH I DO NOT AGREE, I RESPECT CHAIR HEIL FOR PROVIDING FEEDBACK.
I HAVE POSTED A REPLY ON THE COUNTY COMMENT SIDE AND I WOULD ENCOURAGE EVERYONE TO GO READ IT.
I WANT TO REINFORCE THE REASON FOR THE ENABLING ACT BECAUSE IT WILL BE NECESSARY IN THE FUTURE.
ON OCTOBER 6, 2023 A PUBLIC HEALTH ORDER WAS UPDATED.
AND INCLUDES SAFE SURRENDER EVENTS.
I WANT YOU TO GIVE YOUR GUNS UP IN THE CITY OF ALBUQUERQUE AND LAS CRUCES IN THE NEXT 30 DAYS.
THE WATERS ARE NOW IN PROGRESS IN ISRAEL AND UKRAINE AND WHAT WE HAVE SEEN IS THE GOVERNMENT HAVING TO ISSUE FIREARMS TO CITIZENS TO PROTECT THEMSELVES. ON THE BORDER WE HAVE HAD 169 KNOWN TERRORIST ARRESTS SINCE YOUR 23 ALONE.
SO HOW MANY DO YOU THINK OF COME THROUGH THE BORDERS AND ARE AWAITING AN OPPORTUNITY? WE SEE HI CRIME RATES IN ALBUQUERQUE, OUR NEIGHBOR.
WE SEE NOT ENOUGH RESOURCES TO COMBAT DRUG ISSUES AND MENTAL ILLNESS.
WE NEED THE ENABLING ACT IN ORDER TO KEEP OURSELVES CONSISTENT WITH OUR CONSTITUTION.

COMMISSIONER HEIL. DURING THE SEPTEMBER 13 COMMISSION MEETING WE THE PEOPLE WITNESSED A DURING THE PRE-VOTE DISCUSSION, COMMISSIONER BRUCH REMOVED HERSELF FROM THE CHAMBER WITHOUT VERBAL NOTICE.
THE SANDOVAL COUNTY BOARD OF COMMISSION RULES OF PROCEDURE ADOPTED JANUARY 11, 2023 STATES, AND I QUOTE, ANY COMMISSIONER LEAVING A COMMISSION MEETING EARLY IN THE EVENT OF AN UNEXPECTED ILLNESS OR EMERGENCY SHALL MAKE THE CHAIR AWARE OF SUCH DEPARTURE AS EARLY AS POSSIBLE.
AND QUOTE. IT PEERED THAT WE THE PEOPLE WERE NOT MADE AWARE OF THE DEPARTURE.
THE VIOLATION OCCURRED OVER A MONTH AGO AND STILL NO ACCOUNTABILITY.
MYSELF AND OTHERS HAVE BEEN REPRIMANDED AT THIS PODIUM FOR NOT FOLLOWING YOUR RULES AND PROCEDURE.
ONE CAN ONLY WONDER HAS THE TWO TIERED JUSTICE SYSTEM LANDED IN SANDOVAL COUNTY? BEFORE MY NEXT COMMENT I WOULD LIKE TO PREFACE MY COMMENT BY SAYING WE THE PEOPLE WERE PRESENT THE CONSTANT EFFORT OF THE CLERK'S OFFICE TO IMPROVE THEIR PERFORMANCE.
COMMISSIONERS. DO YOU HAVE ANY IDEA HOW NAUSEATING IT WAS TO SIT IN THE PEOPLE'S CHAMBER LAST MEETING AND LISTEN TO YOU APPROVING SPENDING CITIZENS TAX DOLLARS ON UPGRADING THE PRESENT INTERNET SYSTEM TO FACILITATE AND AID OUR SECRETARY OF STATE OFFICE TO CHEAT MORE EFFICIENTLY ON ELECTION DAY.
HAVE YOU HEARD NOTHING WE HAVE ILLUSTRATED TO YOU IN THE PAST 18 MONTHS REGARDING ELECTION FRAUD IN NEW MEXICO? DO YOU NOT UNDERSTAND YOU ARE STATING IN THE SEATS AS A RESULT OF FRAUDULENT TABULATOR'S? WHAT WILL IT TAKE TO GET YOU TO SEE THAT ELECTIONS HAVE CONSEQUENCES?
[00:50:04]
IS THE PRESENT STATE OF OUR COUNTRY NOT ENOUGH TO CONVINCE YOU?THANK YOU. >> CHAIRMAN HEIL: THANK YOU, MARY JO.

C. GOOD EVENING, COUNTY COMMISSIONERS.
TONIGHT I'D LIKE TO TALK ABOUT ELECTION TRANSPARENCY.
ELECTIONS WITH INTEGRITY MUST BE CONDUCTED WITH THE HIGHEST LEVEL OF TRANSPARENCY.
IT MUST PUT SUFFICIENT BEARS AND PLACEMENT HAVE SEVERE PENALTIES FOR THOSE WHO VIOLATE THE MOST SACRED CIVIL INSTITUTION SOCIETY CAN HAVE. LEADING UP TO ELECTION, THE LIST OF ACTUAL VOTERS IS REPORTED AS SOON AS POSSIBLE AFTER POLLS CLOSE. REAL-TIME REPORTING OF WHO HAS ACTUALLY VOTED MUST NOT HAPPEN SO VOTER INTIMIDATION AND HARASSMENT WILL NOT TAKE PLACE WHILE POLLS ARE OPEN. EACH POLLING LOCATION SHALL BE SET UP FOR THE PUBLIC TO OBSERVE THE PROCESS IN AN ORDERLY MANNER.
THE INTIMIDATION OR HARASSMENT OF VOTERS WAS NOT BEAT TOLERATED.
AFTER POLLS CLOSE, THE SORTING AND COUNTING OF BALLOTS SHOULD BE LIVE STREAMED.
WE THE PEOPLE WILL BE ABLE TO SEE BAD ACTORS IN ACTION.
BAD ACTORS CAN THEN BE HELD ACCOUNTABLE BY HONEST FAIR-MINDED PEOPLE WITHIN THEIR OWN PARTY.
TOGETHER WE WILL MAKE A DIFFERENCE.

I'M RHONDA ORCHARD. PLEASE RECORD MY COMMENTS.
NEARLY EVERY MEETING WHEN I INTRODUCED MYSELF I DO ASK THAT MY COMMENTS BE RECORDED.
WHEN CITY ADMINISTRATORS ARE COUNTY MANAGERS OR THEIR RESPECTIVE ATTORNEYS RIGHT OFF CONSENSUS AS HAVING NO MERIT, IT'S A COPOUT. DEPENDING ON ITS IMPORTANCE TO THE NATURE OF THE CONSENSUS, IT'S A COPOUT THAT CAN SOMETIMES RESULT IN PUNITIVE DAMAGES TO THAT CITY OR COUNTY.
SOME OF THE OLD TIMERS MIGHT RECALL A FORMER CITY OF RIO RANCHO ADMINISTRATOR WHO WAS APPOINTED TO THE OFFICE OF FINANCE AND ADMINISTRATION UNDER FORMER GOVERNOR BILL RICHARDSON.
WHEN TAKING ISSUE WITH CONSTITUENTS, I WOULD CAUTION ADMINISTRATORS AND MANAGERS TO CONSIDER THE REALITY OF MERIT, WHETHER IN NEWSPRINT ONE BROADCAST MEDIA.
ESPECIALLY WHEN YOU'RE SPEAKING FROM A POSITION OF REPRESENTING RESIDENTS OF OUR COUNTY.
YOU DON'T HAVE TO AGREE WITH US, BUT WE'RE NOT GOING TO LET YOU TALK DOWN TO US.
I HOPE THAT IS AMERICAN ENOUGH OUR COMMUNITY. SEEKING OUR SAFETY, HEALTH, AND HAPPINESS IN UNLAWFUL WAYS.
PLEASE TRY TO REMEMBER THAT WHEN YOU SPEAK TO US, BUT MORE IMPORTANT WHEN YOU SPEAK FOR US. THANK YOU.

PLEASE HAVE MY COMMENTS RECORDED.
IT IS NOT A MATTER OF IF, BUT WHEN.
EXACTLY LIKE THE ELECTION PLAN AS WE PARAPHRASE FROM THE HUMAN SERVICES DEPARTMENT AND CABINET.
FOR EXAMPLE, A TELEMARKETER EXPANSION ALLOWED TENS OF THOUSANDS OF PHYSICAL AND BEHAVIORAL HEALTH SERVICES WHEN IN PERSON VISITS WERE NOT POSSIBLE. YOU CAN ALMOST HEAR THE PUBLIC FUNDS FRAUD HATCHING.
REMEMBER POTENTIALLY $58.4 MILLION FOR TECHNOLOGY AND NON-IN PERSON VISITS TO WIRE THE WHOLE THING UP. THIS IS ABSENTEE BALLOTS AND SCANNERS SCAN ALL OVER AGAIN.
SEEING IF A PERSON IS NOT REQUIRED ANYMORE, IT'S ALL ELECTRONIC.
BUT WHEN YOU WIN, DO YOU REALLY PAY THE PRICE FOR ALL THESE SCHEMES? THE IDIOTS WATCHING IT HAPPEN KNOW IT'S THE TAXPAYER CITIZENS WANTING THEIR COMMUNITIES OVERRUN FROM SANITATION WORKERS TO FIRST RESPONDERS AND LAW ENFORCEMENT OFFICERS CRUSHED UNDER THE BURDEN OF IT ALL.

OF ALL THE METHODS THEORIES ACTORS HAVE USED UNDER ELECTION INTEGRITY EXPANDING THE TIME FOR WHICH THE PEOPLE CAN VOTE FOR A SINGLE DAY TO NUMEROUS DAYS AND SOMETIMES WEEKS HAVE BEEN ONE OF THE MOST DISRUPTIVE.
WE MUST RETURN TO HOLDING FEDERAL ELECTIONS ON A SINGLE DAY.
ABSENTEE VOTING SHALL BE LIMITED TO VERY FEW EXCEPTIONS AND EVEN WITH THOSE EXCEPTIONS, ALL ABSENTEE BALLOTS SHOULD BE CAST ON ELECTION DAY AND AUTHORIZED POLLING LOCATIONS THAT SHALL FORWARD THE BALANCE CAST TO THE STATE ELECTION OFFICE BY A SECURE CARRIER.
I MIGHT ADD MY HUSBAND AND I RECEIVED SEVERAL UNREQUESTED ABSENTEE BALLOTS EVERY ELECTION.
[01:00:02]
MILITARY PERSONNEL AND THOSE SERVING IN THE UNITED STATES EMBASSY SHALL BE PERMITTED TO VOTE AT PULLING LOCATIONS ESTABLISHED ON THOSE LOCATIONS.ABSENTEE VOTERS SHOULD STILL BE REQUIRED TO PROPERLY ADJUSTER AT THEIR LOCAL ELECTION JURISDICTION AND USE BALLOTS SENT TO THEM BY THEIR JURISDICTION. ELECTION RESULTS WOULD BE KNOWN WITHIN HOURS OF THE POLLING STATIONS CLOSING.
THOSE NAMES WOULD BE KNOWN BY DULY NOTED BY EACH ELECTION TO JURISDICTION.

WE HAVE DOMINION MACHINES THAT HAVE NOT BEEN CERTIFIED ACCORDING TO FEDERAL REGULATIONS.
THESE MACHINES ARE SPOUTING PORTS READY TO BE HACKED.
WE HAVE NO -- WE HAVE SAME-DAY VOTER REGISTRATION.
WHO CAN CHECK ON ANY OF THAT INFORMATION? THEN YOU GO VOTE.
WE HAVE UNSECURED VOTER BOXES.
THE ROAD TO HONEST AND FAIR ELECTIONS AGAIN WITH YOU, SANDOVAL COUNTY COMMISSIONERS.

I'M GOING TO SALUTE YOU IN FRONT OF THIS GROUP HERE AND THANK YOU FOR WHAT YOU DID.
I'M HOPING THAT OTHERS OF YOU ON NOVEMBER 7 WHEN THEY ASK FOR CERTIFICATION, WHY DON'T YOU JUST SEE WHAT THE COMMISSIONER OF STATE DOES? HE STANDS THERE TODAY AND MY HOPE IS THAT HE WINS THIS PRIMARY AND GOES ON AND HELPS OUT IN OTHER PLACES.

WITH ALL DUE RESPECT, DETERMINE HEIL'S CLOSING COMMENTS WERE A GROSS MISCHARACTERIZATION -- THAT PASSED ORDINANCES CONFLICTING WITH STATE AND FEDERAL LAWS AS THE BODY'S JUSTIFICATION FOR NOT PASSING THE ORDINANCE.
BUT WHY EVEN MENTION ORDINANCES WHEN THERE'S NOTHING IN THE RESOLUTION THAT ENCOURAGES THE COMMISSION TO PASS ORDINANCES OR GIVE IT A JUDICIARY ROLE? THE RESOLUTION STATES ANY LAW, MANDATE, OR ORDER ISSUED BY THE STATE OF NEW MEXICO OR AGENT OF THAT IS CONTRARY TO THE UNITED STATES CONSTITUTION IS VOID.
THAT'S ABOUT AS CLEARLY STATED AND CONCISE AS AN ORDINANCE CAN BE WRITTEN.
STATE COURTS MAY INTERPRET AND APPLY FEDERAL LAW.
DETERMINE HEIL'S COMMENT WAS NOTHING MORE THAN A POLITICAL DEFLECTION.
THEY VIOLATED THE WHOLE NUMBER LAW.
WHY IS THE SELECTED BODY SO RETICENT TO SUPPORT THIS RESOLUTION AND AFFORD YOUR CONSTITUENTS THIS PROTECTION? WHY ARE YOU SO WILLING TO PROSTATE YOURSELVES AT STATE AND FEDERAL CULTURES INSTEAD OF EMBRACING -- WHICH REINFORCES THE POWERS THAT LIE WITHIN THIS BODY? WE MUST LOOK NO FURTHER THAN -- INSTEAD OF HER SECOND AMENDMENT FOR MAKING THE ARGUMENT FOR THE PASSAGE OF THE RESOLUTION AND WHY IT IS ESSENTIAL FOR
[01:05:08]
PROTECTING THE CONSTITUTIONAL RIGHTS OF EVERY SANDOVAL COUNTY CITIZEN.I ENCOURAGE ALL OF YOU TO TAKE ANOTHER LOOK AT THIS ACT AND DO WHAT IS RIGHT FOR THIS COUNTY.

IS IN -- HE HAS SENT CERTIFIED LETTERS TO A FEW HAS TARGETED.

NOT THE PROBLEM. AN OFFICER OF THE LAW WHO IS NOT A CHIEF OFFICER WHO RUNS A THREE-WAY STOP AND WORKS OUT OF HIS HOUSE HAS NO INTEGRITY FOR ONE.

A LITTLE BIT ABOUT MYSELF.I'M A RETIRED POLICE OFFICER HERE FOR NINE YEARS NOW.
WORKED NARCOTICS THE PAST 17 YEARS HERE IN MY CAREER IN THE STATE OF NEW MEXICO.
I DECIDED TO STAY IN SANDOVAL COUNTY AND MAKE A DIFFERENCE HERE.
WE ARE GOING ON NINE YEARS IN THIS COUNTY NOW AND I WANT TO THANK EACH AND EVERYBODY FOR HAVING FAITH AND BELIEVING WE CAN DO SOMETHING LIKE THAT IN THIS COUNTY BECAUSE AS MY LAST 12 YEARS HERE, I TRANSPORTED -- DRUG COURTS THE SAME MEN AND WOMEN WHO WERE FALLING BECAUSE THEY HAD NOWHERE TO GO.
PULL MY RETIREMENT, OPEN UP SOME HOMES, AND BRING THESE MEN AND WOMEN STRAIGHT FROM JAILS AND PRISONS INTO THE HOMES I HAVE HERE IN THE COUNTY.
AGAIN, I'D LIKE TO THANK EACH AND EVERYBODY.
IT CAN BE DONE. AGAIN, ONLY CAN TELL YOU IS THANK YOU.
THE PROGRAM IS ONE DAY AT A TIME.
WE'VE GOT AT LEAST EIGHT OR NINE DIFFERENT REHABS DETOX ON BOARD.
WE GET ALL THESE MEN AND WOMEN IN REHAB DETOX AND BRING THEM HERE TO SANDOVAL COUNTY WHERE WE HAVE JOBS ALL AROUND THE CITY ITSELF AND THE COUNTY ITSELF.
THE DISABLED VOCATIONAL RECOVERY PROGRAM.
WE COME INTO THE HOMES AND BUSINESSES.
WE DO PAINTING. TEACH ALL SKILLS AND WOMEN.
WE TEACH THEM SKILLS SO WE CAN PUT THEM IN SOCIETY AGAIN.
DO HAVE A PROGRAM IN SANDOVAL COUNTY.
>> CHAIRMAN HEIL: THANK YOU, MR. AGUILAR. OKAY.
DID I GET THAT CLOSE? >> HI, EVERYBODY.
I HAVE NEVER BEEN TO A COMMISSIONERS MEETING.
I'VE WORKED WITH XAVIER FOR A LONG TIME.
HAVE KNOWN HIM SINCE WE BOTH WORKED AT THE HIGH SCHOOL IN BERNALILLO.
HE WAS THE RESOURCE OFFICER AND I WAS SECURITY.
HE'S DOING A GOOD JOB WITH THE PROGRAM HE'S RUNNING.
I THINK THAT'S WHY I NEEDED TO COME IN AND SAY HE NEEDS SOME HELP FROM YOU ALL.
IF YOU CAN LEND A HELPING HAND, HE'D APPRECIATE THAT.
THERE'S QUITE A FEW MEN THAT HAVE PASSED AND GRADUATED.
THEY ARE NOW MEMBERS OF THE COMMUNITY THAT ARE DOING WELL.
THERE'S A LOT OF WOMEN THAT HAVE PASSED THROUGH THAT ALSO AND THEY ARE DOING WELL.
SO AGAIN, I DON'T HAVE VERY MUCH TO SAY, BUT WE NEED SOME HELP FROM YOU.
OKAY? >> CHAIRMAN HEIL: THANK YOU.
AND MOVING ON TO THE CONSENT AGENDA.
[9.APPROVAL OF CONSENT AGENDA]
CAN I HAVE A MOTION? >> VICE CHAIRMAN MEEK: SO MOVED.
>> CHAIRMAN HEIL: AND A SECOND?
>> CHAIRMAN HEIL: MADAME CLERK.
SO ON THE NEXT COUPLE ITEMS ON THE AGENDA WE ARE GOING TO JUMP AROUND JUST A LITTLE BIT.
WE ARE GOING TO DO 10 A FOLLOWED BY 11 A FOLLOWED BY 10 B.
[10.A.Request for a Motion to Adopt Ordinance No. 10-25-23.10A a Bond Ordinance and underlying Bond Documents (Lease, Indenture and Bond Purchase Agreement) relating to the NMRD Data Center IV, LLC Project. Exhibit B to the Lease contains the arrangement with respect to the payment in lieu of taxes. (Rob Burpo, County Financial Advisor and Jill Sweeney, County Bond Counsel)]
10 A AND 11 A ARE CONNECTED, SO WE THOUGHT IT WOULD BE BETTER TO TALK ABOUT THEM IN SUCCESSION.WE ARE HERE FIRST ON 10 A, WHICH IS CONSIDERATION FOR ADOPTING ORDINANCE 10-25-23.
WHAT'S BEFORE YOU TONIGHT IS THE BOND DOCUMENT.
WITH ME TONIGHT IS JILL SWEENEY TO PRESENT THIS.
[01:20:03]
THESE DIFFERENT PEOPLE THAT HAVE BEEN INVOLVED IN THESE TRANSACTIONS.THEY ARE THE ONES THAT DID THE FIRST TWO UP IN THE NORTH AND CASINO ROAD.
THIS PROJECT, AS YOU'LL SEE IN JUST A MINUTE IS WHAT WE CALL PROJECT NUMBER FOUR OR TAG.
I'LL GET TO THE MAP IN JUST A SECOND.
BASICALLY, WHAT IT IS IS RIGHT ON THE EDGE OF THE ESCARPMENT.
THE FIRST TWO WERE REALLY ON THE VERY EDGE OF THE PAVEMENT VALLEY SCHOOL DISTRICT.
THIS ONE IS $275 MILLION IN THE RIO RANCHO SCHOOL DISTRICT.
IT'S ABOUT A $275 MILLION PROJECT AS OPPOSED TO THE ONE THAT WE DID IN 2019 THAT WAS $70 MILLION AND THE ONE THAT WAS $15 MILLION IN 2021.
VERY SIMILAR STRUCTURES TO THE 21 AND 2019 TRANSACTION.
THE ANNUAL PILOT WAS $100,000 A YEAR.
THE PILOT IN 22 WAS ALSO ONE WHO THOUSAND DOLLARS A YEAR.
THIS ONE IS GOING TO BE SUBSTANTIALLY HIGHER THAN THAT.
WE'LL GET INTO SOME NICE ADDITIONS WE PUT INTO THIS TRANSACTION WE DIDN'T HAVE IN THE PRIOR TWO.
THEY ARE SELLING -- PNM IS BUYING 100% OF THE POWER.
THEY EXPECT TO START CONSTRUCTION RIGHT AT THE FIRST OF THE YEAR.
IT'S GOING TO BE 140 MW OF SOLAR FARM, SOLAR PANELS, AND 50 MW OF BATTERIES.
TO GET THE POWER TO THE SUBSTATION IS ABOUT 3 MILES AND THEN GENERATION TIES HAS ALREADY BEEN PERMITTED AND ACQUIRED, SO EVERYTHING IS IN PLACE TO START THIS.
THEY EXPECT IT'S GOING TO BE ABOUT AN 18 MONTH CONSTRUCTION PERIOD.
IT WILL TAKE ABOUT THAT LONG TO GET THE POWER STARTING TO BE PRODUCED IN 2025.
IF YOU NOTICE NORTH IS TO THE LEFT SIDE.
THAT'S WHERE IT IS. YOU CAN SEE THE DIFFERENCE BETWEEN THE TWO.
IT'S A VERY LONG PIECE OF DIRT AS OPPOSED TO THE OTHER TWO WHICH ARE PRETTY MUCH SQUARES.
BASICALLY, THE SOLAR PANELS HAD BEEN MANUFACTURED IN VIETNAM.
THEY ARE GOING TO COST ABOUT $95 MILLION.
THE BATTERIES MANUFACTURED BY TESLA.
THE LAND COSTS ABOUT $8 MILLION.
TOTAL COST IS ABOUT-- $172 MILLION.
WE PUT SOME COST IN CASE THERE IS COST OVERRUNS.
UNDER THE 2021 LEGISLATION, ALL FIVE OF THE SCHOOL DISTRICTS IN SANDOVAL COUNTY WOULD GET AN EVEN 20% DISTRIBUTION OF THE PAYMENT LIFT TAXES.
SO THE PORTION THERE'S A PART THAT GOES TO THE COUNTY.
THE PART THAT GOES TO THE SCHOOLS, THAT WOULD BE A PORTION 20% EACH TO THE SCHOOL.
IN 2023, LEGISLATION WAS PASSED AND TO SAY IT'S CONVOLUTED WOULD BE AN UNDERSTATEMENT.
IT IS VERY DIFFICULT TO EVEN FACTOR.
TAKES QUITE A WHILE TO EVEN FIGURE OUT.
BASICALLY, IT SAYS 50% OF THE MONEY GOES TO THE SCHOOL DISTRICT WHERE THE PROJECT IS LOCATED.
40% IS BASED ON THE LANDMASS THAT THE SCHOOL DISTRICTS HAVE WITHIN THE COUNTY.
I WANT TO POINT OUT THAT YOUR GIS DEPARTMENT WAS FANTASTIC IN GETTING US A REPORT WE NEED FOR THAT.
[01:25:04]
NOT EVERY COUNTY IS ABLE TO DO THAT AS EFFICIENTLY AS THEY WERE.THAN 10% OF THE POPULATION IS BASED ON THE SCHOOL DISTRICT POPULATION.
BUT HERE'S THE KEY. THE LANGUAGE ON THE SECOND ONE, 40% IS AREAS IN THE COUNTY, RIGHT? THE POPULATION, THOUGH, DOES NOT MATTER WHETHER IT'S IN THE COUNTY WERE NOT.
SO APS HAS 382 STUDENTS AT CORRALES ELEMENTARY.
BUT ACCORDING TO THE STATS, WE HAVE TO DO -- JUST TELLING YOU WHAT THE LAW SAYS. IT WAS PASSED BY A LEGISLATOR FROM YOUR COUNTY.
SO THIS IS BASICALLY WHAT IT LOOKS LIKE.
2.75% OF THE PILOT IS GOING TO GO TO BERNALILLO SCHOOL DISTRICT.
3.34 ALBUQUERQUE PUBLIC SCHOOL.
CUBA WILL GET A LITTLE OVER 7%.
HEIL VALLEY WILL GET 4.49 AND RIO RANCHO IS GOING TO GET ABOUT 20.49.
A TOTAL OF 37.77% OF THE PILOT IS GOING TO GO TO THE DISTRICTS.
THE COUNTY IS GOING TO KEEP 62.23%.
SO THIS IS BASICALLY WHAT IT SAYS.
USE THE FIRST FIVE YEARS THE PAYMENT IN LIEU OF TAXES ARE GOING TO BE BASED AT $2800 PER MEGAWATT.
SO $532,000 FOR THE FIRST FIVE YEARS IS GOING TO BE PAID TO THE COUNTY.
THAT WILL THEN BE DIVIDED UP BETWEEN THE SCHOOLS AND THE COUNTIES, AND YOU CAN SEE THE BREAKDOWN.
THEN IN THE SIXTH YEAR GOES UP BY 5%.
THEN IN YEARS 11 THROUGH 15 IT GOES UP ANOTHER 5%.
THEN 16-20 GOES UP ANOTHER 5%.
THIS IS A FIRST IN SANDOVAL COUNTY.
WE STARTED DOING THAT IN ANOTHER COUNTY LAST YEAR.
IN THE PAST, A LOT OF THE PROJECTS THE PAYMENTS WENT DOWN BECAUSE THE ARGUMENT WAS DEPRECIATION.
THE VALUE OF THE EQUIPMENT WENT DOWN.
OUR ARGUMENT WAS WHO CARES? WE ARE CONCERNED ABOUT THE COST OF INFLATION THAT IMPACTS THE BENEFICIARIES.
ACCOUNTING AND THE SCHOOL DISTRICTS.
PNM FOUGHT HARD FOR THEIR POSITION, AS THEY SHOULD.
I CAN JUST TELL YOU THAT WE STARTED OFF AT $550,000 A YEAR FIXED FOR 30 YEARS AND WE ENDED UP AT 532.
SO WE ENDED UP AVERAGING $603,000 PER YEAR.
SO THINGS WORKED OUT PRETTY WELL FOR US.
IT'S THE LAW OF THE LAND TODAY AND PNM PLANS ON CLOSING THIS BOND VERY SOON.
THEY WANT TO START CONSTRUCTION SO THEY ARE GOING TO BE CLOSING THE BOND VERY SOON.
THIS IS WITH PAYMENTS ARE GOING TO LOOK LIKE PER SCHOOL FOR EACH YEAR.
THEY ARE GOING TO GET ABOUT $500,000 OVER 30 YEARS.
ALBUQUERQUE PUBLIC SCHOOLS ARE GOING TO GET -- TERRIBLE LEGISLATION.
SORRY. CUBA SCHOOL DISTRICT CAN ONLY GET ABOUT 1,000,002 68.
JEMEZ VALLEY AND RIO RANCHO IS GOING TO GET ABOUT 3.6.
>> CHAIRMAN HEIL: COMMENTS OR QUESTIONS?
BLOCH. >> J. BLOCK: THANK YOU.
IF YOU GO BACK TO THE FIRST SLIDE ABOUT PNM BUYING THE POWER FOR 30 YEARS.
[01:30:08]
BLOCK: I THOUGHT I SAW A BULLET SOMEWHERE ON THERE.
>> THEY ARE SELLING 100% OF THIS POWER TO META.
>> J. BLOCK: TO FACEBOOK? >> SENDING ALL THIS POWER TO FACEBOOK.
HAVE A FIXED PRICE FOR THE 30 YEAR PERIOD.
IT'S NOT THAT THEY DIDN'T SEND IT TO US.
THEY WERE SUPPOSED TO SEND IT TO US AND I DIDN'T PRESSURE THEM ON IT.
I CAN TELL YOU ON THE PREVIOUS TRANSACTIONS META WAS PAYING ABOUT $3.19 A KILOWATT HOUR.
THAT WAS THE PURCHASE PRICE. YOU ARE A LITTLE BIT NORTH OF 12?
>> J. BLOCK: I WAS JUST GOING TO ASK WHAT IS THE AVERAGE ONE FOR US?
>> J. BLOCK: THEY GET A NICE DEAL WHERE THE CONSUMER IT'S SCREWED OVER.
THAT'S GREAT. >> I WILL JUST TELL YOU THAT THE SIGNAGE OUT THERE WILL NOT HAVE THEIR NAME ON IT.
>> J. BLOCK: JUST A COUPLE OF QUESTIONS.
THE MONEY THAT THE SCHOOLS GET FOR THIS, AND I'M NOT SURE WHAT THIS LAW WAS.
THE MONEY THAT THE SCHOOL SKIT, IS THAT MONEY TIED TO CERTAIN THINGS THEY CAN USE THAT MONEY FOR?
THEY CAN PLEDGE IT FOR DEBT SERVICE.
THEY CAN USE IT FOR OPERATING EXPENSES.
THE STATUTE IS SILENT ON WHAT THEY CAN DO WITH THE MONEY.
>> J. BLOCK: THE COUNTY FOR THE PILOT, I ASSUME THAT GOES TO THE GENERAL FUND AS WELL.
CAN YOU GO TO THAT ALBUQUERQUE SCHOOL DISTRICT THING HERE? SO HELP ME UNDERSTAND THIS WHERE I CAN EXPLAIN THIS TO MY MOM.
YOU'RE TELLING ME THAT FOR 382 STUDENTS THEY GET $600,000?
>> THE REASON FOR THAT, MR. CHAIRMAN AND COMMISSIONER BLOCK.
THE STATUTE THE WAY IT WAS WRITTEN SAYS THAT THE ALLOCATION OF 40% OF THE ALLOCATION WHERE IT GOES TO IS BASED ON THE ACREAGE OF THE SCHOOL DISTRICT WITHIN THE COUNTY.
IT DOESN'T SAY WITHIN THE COUNTY.
>> J. BLOCK: SO BECAUSE CORRALES IS PART OF APS, IS THAT WHY?
SENATE BILL -- >> J. BLOCK: WHO?
>> WHO WAS THE SENATOR? SHINDO, I'M SORRY.
>> J. BLOCK: DOES THIS INCREASE ANY TYPE OF BURDEN ON THE TAXPAYER AT ALL?
>> THE PROPERTY RIGHT NOW IS GENERATING $2,352 IN PROPERTY TAXES.
SO YOU'RE GOING TO BE JUMPING A BUNCH.
YOU'RE GOING TO GO FROM 3,000,200 -- $3,250,000 TO $352,000.
>> J. BLOCK: THERE'S NOT MUCH OUT THERE RIGHT NOW.
>> THERE'S NOT A WHOLE LOT OUT THERE.
>> J. BLOCK: BOTTOM LINE IS THIS SOLAR PLANT GETS BUILT OUT THERE.
BATTERIES ARE GOING TO BE ASSEMBLED.
DOESN'T MEAN THE MINERALS COMING FROM THE UNITED STATES.
THEY ARE GOING TO BE ASSEMBLED BY TESLA HERE.
THEREFROM OVERSEAS IN VIETNAM.
THE BIG CORPORATION OF META IS GETTING A SWEET DEAL HERE AND THE NORMAL EVERYDAY NEW MEXICANS WHO WERE GETTING BURDENED BY INFLATION AND HIGH ENERGY COSTS ARE GOING TO BE PAYING FOR HAVING FIVE TIMES MORE.
IS THAT CORRECT? DID I SUM IT UP?
>> I'M NOT HERE TO DISPUTE YOUR DESCRIPTION.
>> J. BLOCK: OKAY. THANK YOU, MR. BURPO. THANK YOU, MR.
CHAIR. >> CHAIRMAN HEIL: ANY OTHER COMMENTS?
[01:35:02]
>> K. BRUCH: CHAIRMAN? PERHAPS THIS IS A LEGAL QUESTION BECAUSE I'M NOT SURE I UNDERSTAND.
IF THE STATUTE WERE TO CHANGE IF THIS MOVES FORWARD QUICKLY, WHAT KIND OF IMPACT WITH THAT MAKE
>> THE PROBLEM IS WHEN THE BONDS ARE CLOSED, NOT THE ORDINANCE APPROVED BY YOU GUYS.
WHEN THE INTEL'S OR THE PNM'S OF THE WORLD, THEY HAVE TO ACTUALLY CLOSE THEIR BOND.
WHEN THEY CLOSE THEIR BOND, NEVER STATUTE IS IN PLAY AT THAT TIME IS THE ONE WE HAVE TO GO BY.
>> CHAIRMAN HEIL: ANY OTHER COMMENTS?
COMMISSIONER MEEK. >> VICE CHAIRMAN MEEK: THANK YOU, MR. CHAIRMAN. THE BASIC FACT IS WE'RE GOING TO BE EXCHANGING $3000 A YEAR FOR TAXES TIMES 30 YEARS IN EXCHANGE FOR A TOTAL OF $11,259,000 TO THE COUNTY.
>> CORRECT. >> VICE CHAIRMAN MEEK: OKAY.
THANK YOU VERY MUCH, CHAIRMAN. >> CHAIRMAN HEIL: ANY OTHER COMMENTS? OKAY. I GUESS WE NEED A MOTION ON THIS.
CAN I HAVE A MOTION? >> VICE CHAIRMAN MEEK: SO MOVED.
>> CHAIRMAN HEIL: AND A SECOND.
>> CHAIRMAN HEIL: BEFORE WE CLOSE THIS, ARE THERE ANY OTHER COMMENTS OR QUESTIONS? HEARING NONE, ADAM CLARK.
[11.A.Request for a Motion to Adopt Resolution No. 10-25-23.11A Approving of updated payment in lieu of tax allocations among the County and the School Districts relating to the NMRD Data Center III, LLC Project which was originally approved in January 2022. The resolution updates allocation of the PILOTs in set forth the underlying form of Lease to confirm to recent legislative changes requiring that the Payments in lieu of taxes be allocated according to a new statutory formula. (Rob Burpo, County Financial Advisor and Jill Sweeney, County Bond Counsel)]
>> MR. CHAIRMAN, I THINK WE ARE MOVING ON TO 11 A.
RESOLUTION 11 A IS RESOLUTION 10-25-23.11 K.
THIS GOES EXACTLY TO THE ISSUE THAT MISS COMMISSIONER BRUCH BROUGHT UP JUST A FEW MINUTES AGO.
IN 2022, THIS COMMISSION APPROVED IN IRB FOR THE SECOND PNM PROJECT IN WHAT'S CALLED THE INCINO AREA.
SAME PLAYERS. BUT IT'S BASICALLY THE INCINO NORTH PROJECT.
THAT IS IN THE HEIL VALLEY SCHOOL DISTRICT.
SAME THING. BECAUSE THEY HAVEN'T CLOSED THEIR BOND YET, THE PILOT PROGRAM THAT WAS IN PLACE IN JANUARY OF 2022 HAS BEEN REPLACED BY THE NEW 2023 LEGISLATION.
SO NOW WE HAVE TO CHANGE IT FROM 20% TO EACH OF THE FIVE SCHOOLS TO THE NEW FORMULA.
I TELL YOU IT'S CONVOLUTED AS CAN BE.
BUT THIS PARTICULAR ONE 36.8% OF THE PILOT PAYMENTS WILL GO TO THE SCHOOLS.
THIS IS THE WAY IT WAS BEFORE.
EACH SCHOOL GOT 7.36 IS THE WAY IT WORKED OUT.
EACH SCHOOL LAST TIME WAS GOING TO GET $7360 PER YEAR AND THE COUNTY WOULD GET ABOUT $63,200.
REMEMBER THIS WAS A MUCH SMALLER PROJECT.
IS WITH THE NEW ONE WILL LOOK LIKE.
BERNALILLO PUBLIC SCHOOL DISTRICT WILL GET $2801.
ALBUQUERQUE PUBLIC SCHOOLS, 3000.
AGAIN, IT'S BASED ON 50% LOCATION WHERE THE PROJECT IS.
AND THEN 10% BASED ON THE POPULATION OF THE SCHOOL DISTRICT, WHEREVER THOSE KIDS MAY BE.
SO THE RESOLUTION BEFORE YOU BASICALLY IS CHANGING IT FROM WHAT I SHOWED YOU PREVIOUSLY, FROM THIS FOR EACH SCHOOL GOD $7360 IS CHANGING IT TO THIS.
SOMEBODY'S GOING TO GET MORE. SOMEBODY'S GOING TO GET LESS.
THAT'S BECAUSE OF SENATE BILL 474 AND THE FACT THAT PNM IS GOING TO CLOSE THE BOND.
[01:40:06]
WHAT THEY ARE GOING TO START DOING, BASICALLY, IS CONSTRUCTION ON THE SECOND PROJECT AND THE NEW PROJECT AT THE SAME TIME. SO THAT IS WHAT RESOLUTION 10-25-23.11 A DOES.HE JUST CHANGES THE DISTRIBUTION OF THE PILOT PAYMENTS FROM $7360 PER STUDENT PER SCHOOL TO THIS CALCULATION.
IT'S JUST BECAUSE THE STATUTES CHANGE.
>> CHAIRMAN HEIL: LET'S HAVE A MOTION ON THIS ITEM AND THEN WE CAN ASK QUESTIONS.
BRUCH: SECOND. >> CHAIRMAN HEIL: ANY COMMENTS OR QUESTIONS?
>> J. BLOCK: MR. CHAIR. >> CHAIRMAN HEIL: COMMISSIONER BLOCK.
>> J. BLOCK: THE OTHER ONE IF I REMEMBER CORRECTLY WAS GOING TO BE COMPLETE SOMETIME IN JUNE 2025.
>> CORRECT. >> J. BLOCK: IS THIS ONE ROUGHLY THE SAME TIME?
>> J. BLOCK: THIS ONE IS MUCH SMALLER.
THEY MAY FINISH THIS ONE A LITTLE BIT SOONER, BUT I MEAN, THEY ARE GOING TO BE DOUBLING OF THEIR MANPOWER AND SINCE THEY WERE ABOUT, WHAT IS THAT, 9 MILE DIFFERENCE BETWEEN THOSE TWO.
BLOCK: THIS IS WHERE PNM AGAIN FOR 30 YEARS ARE GOING TO SELL THE POWER TO META, CORRECTLY WHICH THE VALUE WE'RE GETTING ONLY PROPERTY TAX? CAN YOU REFRESH MY MEMORY?
BASICALLY, GETTING TO WHAT VICE CHAIR MEEK WAS TALKING ABOUT IT'S 1200 BUCKS AND WE ARE GETTING --
>> J. BLOCK: AND SCHOOLS WILL GO FROM ZERO TO THOSE PARTICULAR NUMBERS?
GOD KNOWS OUR SCHOOLS NEED HELP WITH NEW MEXICO BEING LESS.
THANK YOU FOR PUTTING THIS TOGETHER IN EXPLAINING IT IN LAYMAN'S TERMS FOR US.
MR. CHAIR. >> CHAIRMAN HEIL: ANY OTHER COMMENTS? SEEING NONE, MADAME CLERK.
>> VICE CHAIR MEEK. >> VICE CHAIRMAN MEEK: YES.
CHAIRMAN, COMMISSIONERS, THANK YOU VERY MUCH.
APPRECIATE IT. JUMPING BACK TO ITEM 10 B.
[10.B.Request for a Motion of Approval for Proposed Amendments to the Comprehensive Zoning Ordinance regarding Procedures for certain types of Planning & Zoning Cases currently scheduled for the Board of County Commissioners.]
CHAIRMAN HEIL AND MEMBERS OF THE COMMISSION.
I AM PLEASED TO INTRODUCE ITEM 10 B OF OUR AGENDA TONIGHT.
IT IS A REQUEST FOR MOTION OF APPROVAL FOR PROPOSED AMENDMENT TO THE SANDOVAL COUNTY COMPREHENSIVE ZONING ORDINANCE REGARDING PROCEDURES FOR ZONE CHANGE CASES.
BUT UP UNTIL NOW WE ARE ORDINARILY SCHEDULED FOR THE COUNTY BOARD OF COMMISSIONERS TO CONDUCT A SECOND PUBLIC HEARING FOR, WHICH DUPLICATED THE PROCESS THAT OUR ZONING AND PLANNING COMMISSION ALREADY FORMED.
GIVEN THAT THE BOARD OF COUNTY COMMISSIONERS ARE AUTHORIZED TO REVIEW AND CONSIDER PROPOSED CHANGES TO THE ZONING ORDINANCE, THE PURPOSE OF THIS REQUEST IS TO FINALIZE ADOPTION OF RECOMMENDED PROCEDURAL CHANGES TO STREAMLINE REVIEW PROTOCOL FOR THESE ZONE CHANGE CASES.
I WOULD ASK MIKE IF WE HAVE A CHART.
THE ZONING ORDINANCE CHANGE CRAFTED --
>> CHAIRMAN HEIL: CAN YOU MAKE THAT CHART BIGGER? OR PASS OUT BINOCULARS?
>> AS HE'S DOING THAT, WHILE STATE THAT THE ZONING ORDINANCE --
YOU CAN SCROLL DOWN THROUGH IT.
THAT'S BETTER. >> SO THE ZONING ORDINANCE CHANGE CRAFTED WOULD ALLOW ZONE CHANGE REQUEST TO BE PROCESSED THE FOLLOWING WAYS. AS WE LOOK AT THE CHART, WHEN WE FIRST GET AN APPLICATION, IT GETS PREPARED FOR THE ZONING AND PLANNING COMMISSION TO CONDUCT. THE PLANNING AND ZONING COMMISSION WOULD RECOMMEND APPROVAL OR DENIAL TO THE GOVERNING BODY.
[01:45:02]
SO ON THE FAR LEFT IS IN RED BECAUSE OF THE PLANNING AND ZONING COMMISSION RECOMMENDS DENIAL AND THERE'S NO APPEAL FILED THE APPLICATION DOES NOT PROCEED. THE ADMINISTRATIVELY WE WOULD HAVE THEM WAITING HERE TO REAPPLY.IN THE NEXT SCENARIO IN THE GREEN BLOCK IF THE PLANNING AND ZONING COMMISSION RECOMMENDS APPROVAL AND NO APPEALS FILED, THEN IT SIMPLY IS PLACED ON THE GOVERNING BODY CONSENT AGENDA FOR FINAL APPROVAL.
THE ZONE WOULD BE CHANGED AND NO FURTHER ACTION REQUIRED.
HOWEVER, IN THE LAST SCENARIO IF THE PLANNING AND ZONING COMMISSION APPROVES APPROVAL OR DENIAL AND AN APPEAL IS FILED, THEN IN THAT CASE IN THAT CASE ONLY GOVERNING BODY WOULD BE PLACED ON THE AGENDA FOR THE GOVERNING BODY FOR APPEAL ESSENTIALLY BECOMING A BECAUSE I JUDICIAL APPEAL SITUATION. THOSE ARE THE THREE CHANGES.
STAFF RECOMMENDS APPROVAL OF THESE AMENDMENTS TONIGHT.
THANK YOU FOR YOUR TIME AND CONSIDERATION AND RESPECTFULLY STAND FOR CONSIDERATION.
>> CHAIRMAN HEIL: CAN I HAVE A MOTION?
>> J. JONES: SO MOVED. >> K. BRUCH: SECOND.
>> CHAIRMAN HEIL: ANY QUESTIONS OR COMMENTS?
>> J. BLOCK: MR. CHAIR, REAL QUICK.
DIRECTOR, IF A AN THE ISSUE COMES UP IN FRONT OF THE PLANNING AND ZONING BOARD AND COMMISSION SOME CASE WHETHER IT'S IN THE EASEMENT OR ZONING ISSUE, WHATEVER IT IS AND IT GETS APPROVED BECAUSE IT HAS MET ALL REQUIRED STATUTES, WHETHER IT'S OF THE FEDERAL, STATE, OR COUNTY LEVEL.
WHO CAN APPEAL THAT? IF THERE IS LIKE A DISPUTE BETWEEN LET'S JUST SAY A PRIVATE RESIDENCE WHO WAS UPSET ABOUT, I DON'T KNOW, A CARWASH COMING IN OR SOMETHING LIKE THAT, BUT IT'S ZONED FOR THAT, WHO CAN APPLY NO MORE APPEAL THAT? WHO CAN APPEAL THE DECISION ON A BUSINESS OR EASEMENT OR SOMETHING LIKE THAT?
EITHER THE APPLICANT OR PRIVATE CITIZEN THAT THE NEIGHBOR OF THE APPLICANT.
JUST ANY CITIZEN SO IT'S NOT LIMITED TO APPLYING A PARTY.
>> J. BLOCK: IF SOMETHING IS APPROVED BY THE P IN Z, WHO FILES THE APPEAL? IS IT FILED WITH YOU GUYS?
>> CHAIR HEIL, COMMISSIONER BLOCK, IN OUR OFFICE.
BLOCK: WHAT TYPE OF BOARD OR WHO IN THERE GIVES THE THUMBS-UP OR THUMBS DOWN?
>> IF IT'S SUBMITTED WITHIN A 15 DAY PERIOD, THAT APPEAL WOULD BE BROUGHT IN THE SCENARIO WHERE THE YELLOW BLOCK IS. THAT IS THE REASON FOR THAT WHOLE SCENARIO.
>> J. BLOCK: SO YOU HAVE 15 DAYS TO DO AN APPEAL?
>> IS THAT 15 BUSINESS DAYS OR CALENDAR DAYS? SO THREE WEEKS, BASICALLY.
IT COMES TO US AND IT'S NOT IN A CONSENT AGENDA.
THERE CAN BE A PUBLIC HEARING ON THAT CONTENT ITEM, CORRECT?
CHAIR. >> MR. CHAIR, IF I MAY, IT SOUNDED LIKE COMMISSIONER BLOCK YOU WERE ASKING WHETHER OR NOT THE STAFF AFTER AN APPEAL IS FIRED HAS ANY SAY IN THIS?
>> NO. IT'S NOT WHAT I WAS ASKING.
I WAS JUST ASKING WHEN AN APPEAL IS FILED I ASKED WHO DECIDES ON THAT APPEAL.
HE SAID THE STAFF, THE PNC, THAT'S WHAT I THOUGHT I HEARD.
>> THAT'S WHAT I THOUGHT YOU WERE SAYING AND THAT IS NOT THE CASE.
IF AN APPEAL IS FILED AFTER THE PLANNING AND ZONING COMMISSION HAS RECOMMENDED APPROVAL OR NOT, THEN THAT APPEAL COMES TO THE COUNTY BOARD OF COMMISSIONERS FOR FINAL APPROVAL.
DOES NOT START AT THE BEGINNING AND GOES BACK THROUGH THE PROCESS.
[01:50:01]
I THOUGHT I HEARD IT PASSES THE PNC.
GOES TO THAT DIRECTORATE TO DISCUSS THE APPEAL, BUT IT COMES TO US AS A GOVERNING
BODY. >> THEY ACT -- AS AN APPEAL BASED ON THE RECORD FROM THE PLANNING AND ZONING.
>> IT IS A QUASIJUDICIAL FUNCTION OF THE COUNTY AT THAT POINT.
CHAIR. >> CHAIRMAN HEIL: WHO FROM THE CITIZENS STANDPOINT CAN APPEAL? ANY CITIZEN IN THE COUNTY WERE ONLY THOSE CITIZENS THAT ARE DIRECTLY IMPACTED BY THE ISSUE?
>> DID I TURN IT BACK? OKAY. CHAIRMAN HEIL, ANY CITIZEN OF THE COUNTY CAN BE NOT NECESSARILY TO BE A PARTY TO THE APPLICANT.
FORGIVE ME IF I MISUNDERSTOOD.
IT'S THE STAFF THAT PACKAGED THE APPLICATION.
WE'VE NOT BE MAKING ANY DECISION ADMINISTRATIVELY.
>> AT THAT POINT IT WOULDN'T BE KIND OF IN A RECOMMENDATION PHASE.
IT WOULD BE BY DUE PROCESS REQUIRED TO SUBMIT THE APPEAL FORWARD.
BLOCK: I THOUGHT FROM WHAT WAS JUST SAID THERE'S A RECOMMENDATION THAT COMES TO US FROM STAFF.
>> IS ACTUALLY THE RECOMMENDATION THAT COMES FROM THE PLANNING AND ZONING COMMISSION.
THEY DON'T LIKE THE DECISION, THEY CAN APPEAL THAT DECISION.
>> J. BLOCK: WHAT'S THE TIMELINE? I UNDERSTAND IT'S APPROVED THERE'S NO APPEAL IT COMES BACK TO QUICK I WOULD IMAGINE.
WHAT'S THE TIMELINE IF IT'S APPROVED OR NOT APPROVED WITHIN APPEAL.
HOW FAST IS A COME TO THE COMMISSION?
>> BE PLACED ON THE NEXT POSSIBLE AGENDA.
>> CHAIRMAN HEIL: ANY OTHER COMMENTS?
MADAME CLERK. >> CLERK: CHAIR HEIL.
[10.C.Request for a Motion of Approval for Proposed Amendments to the Sandoval County Subdivision Regulations regarding Procedures for Plat Vacation Cases currently scheduled for the Board of County Commissioners.]
>> [INDISCERNIBLE] THERE WE GO.
THIS IS A REQUEST FOR MOTION OF APPROVAL FOR PROPOSED AMENDMENT TO SANDOVAL COUNTY SUBDIVISION REGULATIONS REGARDING PROCEDURES FOR PLAT VACATION CASES THAT UP UNTIL NOW WAS ORDINARILY SCHEDULED FOR THE BOARD OF COUNTY COMMISSIONERS AS OPPOSED TO OUR PLANNING AND ZONING COMMISSION.
THE PURPOSE OF THIS REQUEST IS TO FINALIZE ADOPTION OF RECOMMENDED PROCEDURAL CHANGES TO STREAMLINE REVIEW PROTOCOL FOR PLAT VACATION CASES.
THERE'S NO FLOWCHART ON THIS ITEM AS IT IS NOT RECOMMENDED FOR CONSENT AGENDA BUT IS FINALIZED.
DUE TO ITS ADMINISTRATIVE REVIEW NATURE IS FINALIZED IN THE PLANNING AND ZONING COMMISSION.
SEEING THAT THIS MINIMUM TWO WEEK PUBLICATION SCHEDULE FROM SEPTEMBER 13, 2022 FOR REVIEW OF THESE PROPOSED CHANGES HAVE BEEN MET, STAFF RECOMMENDS APPROVAL OF THIS AMENDMENT TONIGHT.
AGAIN, I THANK YOU FOR YOUR TIME AND CONSIDERATION AND STAND FOR ANY QUESTIONS.
>> CHAIRMAN HEIL: CAN I HAVE A NOTION?
>> VICE CHAIRMAN MEEK: SO MOVED.
>> CHAIRMAN HEIL: COMMENTS OR QUESTIONS? I JUST WANT TO ADD A COMMENT HERE THAT BASICALLY THESE PLAT VACATIONS ARE TYPICALLY FOR A PROPERTY OWNER TO VACATE WITHIN THEIR OWN
[01:55:04]
PROPERTY. THE FACT THAT WE HAVE HISTORICALLY BROUGHT THEM TO THE COMMISSION IS SORT OF UNNECESSARY PLANNING AND ZONING BOARD CERTAINLY HAS THE CAPABILITY TO MAKE THAT DECISION.>> CHAIRMAN HEIL, THAT'S CORRECT.
>> CHAIRMAN HEIL: ANY OTHER COMMENTS? HEARING NONE, MADAME CLERK.
[11.B.Approval of Resolution No. 10-25-23.11 B to Dispose, Remove or Revise Items in the Sandoval County Inventory/Assets.]
>> MR. CHAIR, COMMISSIONERS, ARE YOU GOING TO GET THIS? I DIDN'T SEE YOU BACK THERE.
>> CHAIRMAN, COMMISSIONERS, BY THE WAY JEFF STOWE, DEPUTY DIRECTOR OF IT AND I'M HERE TO REPRESENT THE APPROVAL OR REQUEST FOR APPROVAL OF RESOLUTION NUMBER 10-25-23.11 B TO DISPOSE, REMOVE, OR REVISE ITEMS IN THE SANDOVAL COUNTY INVENTORY OR ASSETS.
ESSENTIALLY, EVERY YEAR THE COUNTY COLLECTS ALL THE OLD EQUIPMENT, IT WOMEN SPECIFICALLY, AND STORES IT DOWNSTAIRS UNTIL IT CAN BE DISPOSED OF PROPERLY.
WE ARE HERE TO REQUEST THAT WE CLEAN HOUSE AND REMOVE A PILE OF JUNK.
THIS IS ALL JUST OLD WORN OUT OUT OF DATE AND HOLDS NO VALUE.
CAN I HAVE A MOTION? >> J. BLOCK: SO MOVED.
>> CHAIRMAN HEIL: ANY COMMENTS OR QUESTIONS?
CHAIR? >> CHAIRMAN HEIL: COMMISSIONER BLOCK.
>> J. BLOCK: I ASSUME IT CANNOT BE USED BY ANY OTHER ORGANIZATION HERE IN THE COUNTY?
>> THE EQUIP HAS BEEN STRIPPED BY ONLY CENTRAL PARTS.
>> J. BLOCK: SO IT'S NONOPERATIONAL.
>> J. BLOCK: HOW LONG DO WE NORMALLY HAVE TO STORE THIS STUFF TO DISPOSE OF IT?
>> WOULD LIKE TO TRY TO START GETTING RID OF IT EVERY YEAR.
WE JUST HAVE NO PLACE TO PUT IT.
WAS THAT THE QUESTION, COMMISSIONER?
DO WE HAVE STUFF IN THERE THE LONGEST GETS DISPOSED OF?
>> TAKE THE LONGEST STUFF IN THERE AND GET RID OF IT?
>> WE TAKE INVENTORY AS IT COMES IN AND ONCE A YEAR WE CLEAN IT OUT.
>> J. BLOCK: WHERE DO YOU DISPOSE IT?
>> IT IS SECURELY STORED IN OUR STOREROOM.
>> J. BLOCK: NO, ONCE YOU DISPOSE WHERE DOES IT GO?
BLOCK: IS THERE A REASON YOU DON'T BRING STUFF TO THE LANDFILL? IS IT EASIER?
>> WE HAVE TO SUBMIT TO THE STATE AND REQUEST FOR THIS.
THE STATE HAS TO APPROVE IT AND THAT'S A LONG PROCESS.
>> MR. CHAIRMAN? I WOULD NOTE THERE'S A BILL BEFORE THE LEGISLATOR AND PASSED LEGISLATOR UNANIMOUSLY BECAUSE EVEN THE SMALLEST MUNICIPALITY IN THE STATE IS EXEMPT FROM STATUTE.
IT WAS VETOED BY THE GOVERNOR.
THIS IS A PIECE OF LEGISLATION I ASKED THE COUNTY LOOK AT MAYBE BRINGING FORWARD AGAIN SO WE DON'T HALF TO JUMP THROUGH THESE HOOPS AND WE CAN GET RID OF JUNK WITHOUT STATE APPROVAL.
ANY OTHER COMMENTS? MADAME CLERK.
ITEM 14 NEXT BOARD OF COUNTY COMMISSIONERS NOVEMBER 8 AT 6:00 P.M.
[14.ANNOUNCEMENT OF THE NEXT BOARD OF COUNTY COMMISSIONERS MEETING NOVEMBER 8, 2023, at 6:00 P.M.]
STATE AGAIN THERE IS A WORK SESSION ON OCTOBER 10 FROM 2:00-5:00.THAT BRINGS US TO COMMISSIONER DISCUSSION.
[15.COMMISSIONERS DISCUSSION]
WHAT? WHAT DID I SAY?BLOCK: YEAH. THAT WAS -- >> CHAIRMAN HEIL: OCTOBER 30.
[02:00:08]
CHAIR? >> CHAIRMAN HEIL: COMMISSIONER BLOCK.
>> J. BLOCK: THANK YOU, SIR. JUST TO THANK THE PUBLIC FOR BEING HERE AND SPEAKING OF.
REALLY QUICK, I KNOW SOME OF YOU HAVE BEEN PUBLICLY TARGETED FOR SPEAKING UP WHERE YOU MAY HAVE LOST YOUR JOB OR BECAUSE AN ELECTED OFFICIAL OR HIS OR HER MINIONS HAVE TARGETED AND COMPLAINED TO HER WORKPLACE.
I FIND THAT COMPLETELY UNACCEPTABLE AND IF THAT HAPPENS I WOULD HOPE THERE'S AN INVESTIGATION BECAUSE I'M VERY SORRY FOR SOMEBODY LOSING THEIR JOB BECAUSE THERE WERE COMPLAINTS TO THEIR EMPLOYER.
TALKED A LOT ABOUT THE BORDER.
WE HAD ANOTHER BANNER YEAR FOR ANOTHER RECORD OF OVER 2.5 MILLION PEOPLE ENTERED ILLEGALLY THE COUNTRY AND JUST ANOTHER RECORD MONTH OF 269,000 PLUS IN SEPTEMBER.
BY THE WAY, THE TERROR WATCH LIST OR A.
THERE WAS A COMBINED 11 TERRORIST, THE BORDER FROM -- 282 FROM JANUARY, 2021 UNTIL THE PRESENT AND WE HAVE NO IDEA HOW MANY GOT THROUGH.
IT'S PRETTY SCARY AFTER WHAT HAMAS -- YOU NEED HELP MAPPING IT TO WHAT AFFECTS OUR CITIZENS HERE, THE AGGREGATED INFLATION RATE, MR. CHAIR, WAS 2.749% IN JANUARY 2021.
THAT HAS NOW AGGREGATED INTO A 21.15% RATE TODAY FOR RESIDENTS.
WHICH BY THE WAY, MR. CHAIR, AFFECTS THE AMERICAN DREAM OF HOME OWNERSHIP ABSOLUTELY.
YOU SEE MORTGAGE RATES TOP 8%, WHICH IS THE HIGHEST RATE SINCE 2011.
THAT TRANSLATES TO AROUND $1000 A MONTH FOR A $400,000 HOUSE.
RENT AFFORDABILITY, BY THE WAY, HAS DROPPED TO ITS LOWEST LEVEL IN DECADES, WHICH IS BAD.
OBVIOUSLY, MONTHLY PAYMENTS ON NEW VEHICLES AS REACHED A RECORD HIGH.
SHE CAN COMPLAIN ABOUT IT, IT'S NOT TRUE.
DON'T DENY IT. DON'T BE A DENIER.
GAS NOW HAS BEEN ABOVE THREE DOLLARS A GALLON FOR 890 DAYS PLUS AND EXPECT IT TO GO UP WITH THE WAR IN THE MIDDLE EAST. REAL WAGES REMAIN MUCH LOWER TODAY THAN THEY WERE IN 2021 IN JANUARY.
WHITE FAMILIES HAVE SEEN -- GO UP.
BLACK FAMILIES HAVE SEEN THEIR INCOMES GO DOWN 1.6% AND HISPANICS HAVE SEEN INCOMES GO DOWN 1.1% ACCORDING TO STATISTICS OF THE FEDERAL RESERVE.
BASICALLY, USING A DECREASE WHILE PRICES HAVE RISEN 17.7%.
ACTUALLY, MR. CHAIR, THAT'S NOT GOOD NEWS BECAUSE SPENDING IS UP BECAUSE THINGS COST MORE.
BUT MR. CHAIR, THERE'S ALSO GOOD NEWS.
250,000 JOBS WERE ADDED TO THE ECONOMY LAST MONTH.
IT NEEDS TO CHANGE AND I APPRECIATE THE PRESIDENT GOING OVER TO ISRAEL.
THAT WAS GREAT FOR HIM TO DO THAT.
I KNOW HE'S WORKING HARD. WE SAW HIM AT THE BEACH THERE IN THE NEW SITUATION ROOM, BUT IT IS A CRISIS, MR. CHAIR. AND IS AFFECTING US BECAUSE WE DON'T KNOW WHAT THE HELL CAME THROUGH THE BORDER WITH THESE TERRORISTS.
THE BORDER NEEDS TO BE SHUT DOWN.
I DON'T KNOW WHAT YOU'RE TAKING FOR DRUGS, BUT THE BORDER IS A PROBLEM.
>> CHAIRMAN HEIL: THANK YOU, COMMISSIONER BLOCK.
ANY OTHER COMMENTS? I HAVE A FEW. FIRST OF ALL, I DON'T WANT ANYONE TO CONSIDER THAT MY COMMENTS ARE TALKING DOWN TO ANYONE, JUST IN EXCHANGING OF DIFFERENT OPINIONS AND FACT ON ISSUES.
[02:05:06]
THERE HAVE BEEN DISCUSSIONS THIS EVENING, AS MANY OTHER EVENINGS.OUR PUBLIC COMMENT ABOUT SUGGESTIONS THAT THE SANDOVAL COUNTY EXCEEDED ITS AUTHORITY TO PASS AND/OR TO ENFORCE LAWS.
I WANT TO USE THE ENABLING ACT AS AN EXAMPLE.
IS BEEN PROPOSED THE COUNTY COMMISSION ADOPT ENABLING ACT.
INTO THE COUNTY'S CODE OF ORDINANCE, THE ORDINANCE DECLARES ANY LAW, MANDATE, OR ORDER ISSUED BY THE GOVERNMENT BY THE STATE OF NEW MEXICO OR AGENT THEREOF THAT IS CONTRARY TO THE CONSTITUTION OF THE UNITED STATES OR CONSTITUTION OF THE STATE OF NEW MEXICO IS VOID AND UNENFORCEABLE.
HOWEVER, SANDOVAL COUNTY LACKS AUTHORITY TO MAKE OR ENFORCE SUCH AN ORDINANCE.
MR. MARKER IN HIS ENABLING ACT POSITION IS THAT HIS PROPOSAL WOULD FORCE THE GOVERNOR TO SUE THE COUNTIES WHICH ENACTED IT AND SHE WOULD BE FORCED TO DEFEND HER ACTIONS.
HOWEVER, MR. MARKER HAS IT BACKWARDS.
THE ONUS IS NOT ON THE GOVERNOR TO SHOW HER ACTIONS ARE VALID.
IT'S ON THE CHALLENGER TO SHOW THEY ARE INVALID.
BUT NEW MEXICO CONSTITUTION GIVES NO AUTHORITY TO COUNTIES.
A COUNTY IS BUT A POLITICAL SUBDIVISION OF THE STATE AND IT POSSESSES SUCH POWERS AS EXPRESSLY GRANTED BY THE LEGISLATOR TOGETHER WITH THOSE NECESSARILY IMPLIED TO IMPLEMENT THOSE EXPRESSED POWERS.
MR. MARKER'S ARGUMENT THAT MANDATE ORDERS ARE NOT LAW HAS BEEN REJECTED BY THE COURTS.
ADMINISTRATIVE LAW SINCE THE ORDERS ISSUED BY THE GOVERNMENT IS INDEED LAW.
THE PUBLIC HEALTH ACT GIVES AUTHORITY TO ISSUE ORDERS.
THOSE ORDERS ARE LAW UNTIL THEY ARE OVERRULED BY THE COURTS.
MR. MARKER'S ARGUMENTS HAVE BEEN REJECTED AGAIN AND AGAIN IN AMERICAN HISTORY.
JOHN C CALHOUN IN HIS NULLIFICATION CRISIS AND SOUTHERN STATES AND MASSIVE RESISTANCE TO SCHOOL DESEGREGATION.
MR. MARKER'S REFUSAL WILL -- AND IS NOT GROUNDED IN THE CONSTITUTION OF THE LAWS OF NEW MEXICO.
SO I JUST SHARE THAT OTHER PERSPECTIVE AND I'M SURE THE DISCUSSION WILL CONTINUE.
ANY OTHER COMMENTS? CAN I HAVE A MOTION ON ITEM 16?
>> SO MOVED. >> CHAIRMAN HEIL: AND A SECOND.
>> SECOND. >> CHAIRMAN HEIL: STAND ADJOURNED.
